COUNCIL RESOLUTION — GENERAL FORM
RESOLVED, upon the appeal of A. L. Mueller, under the
Zoning Code, for a waiver of the eight (8) foot buffer require-
ment for parking adjacent to residential use, and, upon his
application for a permit to increase an existing parking lot
from ten (10) spaces to thirty -one (31) spaces in the vicinity of
the southwest corner of East Seventh Street and Johnson Parkway,
more particularly described as the East 30 feet of English Street
vacated and adjoining and following: except east 30 feet, Lot 12,
Block 3, Lorena Park Plat 2, St. Paul, Minn. and subject to
easements, Lots 1 and 2, Block 1, Auditor's Subdivision No. 37,
St. Paul Minn., that the general provisions of said Zoning
Code as they apply to off - street parking facilities are hereby
determined and varied to the extent necessary to conform with
the final plans filed with the City Planning Board August 27,
1964, and that the petitioner, A. L. Mueller, be permitted to
install and operate a 31 -car private off - street parking facility
in conjunction with the operation of his funeral home, all in
accordance with the plans approved August 27, 1964, subject to
compliance with the provisions of all applicable;provisions of
municipal ordinances, State statutes and rules and regulations
of public authorities having cognizance.

This is in the matter of A. L. Mueller's 1) appeal to waive the 8` buffer
requirement for parking lots adjacent to residential development, and 2) -
application for a permit to increase an existing parking lot from ten-
spaces to approximately 31 spaces on ,property located at the southwest
corner of E. Seventh Street and Johnson Parkway which'is described as the
east 30 feet of English Street vacated and adjoining and following: ex.
east 30 feet, Lot 12, Block_3, Lorena_Park Plat and subject to easements
Lots 1 and .2, Block 1, Auditor's Sub. # 37.' The property is zoned commercial.
On April 18, 1964, tbe-City Council granted a permit'for a ten car off -
street parking lot on the easterly portion of the subject property. Additional
,property has been acquired, and it is proposed to enlarge the facility by
adding approximately 21 carrspaces.' Tbe- expanded parking lot will be
immediately adjacent•to a residence which is owned by the applicant, and
which will, in'tbe near future, be removed for further expansion of said
parking lot. The Zoning Ordinance requires an 8 foot'setback for a parking
lot which is adjacent to a residential%development, and the applicant is
therefore appealing from.,tbis provision and must secure Council approval
before proceeding with the parking lot. x
The Board of Zoning considered this matter at its regular meeting on Aug-
ust 27, 1964. The staff reported that the plans met all of the required
standards with the exception of the -'8 foot buffer,.and bad been approved
by the Traffic Engineer: The.staff reported.f urtber that the requested
waiver of -tbe required 8 foot setback was reasonable acid would not have a
detrimental effect on the adjoining property. Inconsideration of these
factors, the Board of Zoning recommends the granting of the appeal to waive
the required 8 foot parking lot setback along the west line of the subject
property, and the permit,to enlarge the existing facility to,31 car spaces
in accordance with final plans dated August 27, 1964.

Gentlemen:
It has been brought to my attention by our archi-
tect, Mr. Richard Rafferty, that a technicality
exists in applying for additional parking area to
the City Planning Board.
I am informed by him that it is necessary to have
an 8 foot buffer between my parking lot and the
adjacent lot owner. I, however, do own the adja-
cent 40 foot area where a home now stands on it,
and I am asking you to waive this requirement for
the 8 foot buffer strip.
