06-479Council File # �� Resolurion # Green Sheet # (�,.3� b � RESOLUTION Presented Sy Referred To 1 WHEREAS, Chapter 293 of i 2 noise in the City of Saint Paul; and � Saint Paul Legislative Code was enacted to zegulate the subject of 4 WHEREAS, §293.11 provides for the granting of variances from the sound level limitations g contained in §293.09, upon a finding by the City Council that full compliance with Chapter 293 would g constitute an unreasonable hardship on the applicant, other persons or on the community; and 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 WHEREAS, the Public Art Saint Paul, represented by Christine Podas-Larson, who has been designated as the responsible person on the application, has applied for a variance to allow power cutters, grinders, and cranes for the purposes of cutting and moving stone at 235 Marshall Avenue; and WHEREAS, applicant is seeking a variance for the hours of 6:00 am. to 9:00 p.m., starting May 22, 2006, until June 30, 2006; and WHEREAS, if applicant is not granted a variance stone cutters visiting Saint Paul will be unable to create stone sculptures; and WHEREAS, the Office of License, Inspections, and Environmental Protection has reviewed the application and has made recommendations regarding condirions for the variance; now, therefore, be it RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to Public Art Saint Paul, subject to the following conditions: 1) 2) The variance shall be for the hours of 6:00 a.m. to 9:00 p.m. starting May 22, 2006, until June 30, 2006; All electronically powered equipment used in conjunction with the event shall not exceed 90 dBa, as measured fifiy (50) feet from the noise source; CITY OF SAINT PAUL, MINNESOTA �� 42 43 44 45 46 47 48 49 50 51 52 53 54 55 56 57 58 59 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 77 78 79 80 81 82 83 84 85 86 87 88 89 4) All electronically powered equipment shall be turned off no later than 9:00 p.m., starting May 22, 2006, until June 30, 2006 FURTHER RESOLVED, that any violations of the condirions set forth above starting May 22, 2006, until June 30, 2006, may result in denial of future requests for the grant of a noise variance, in addition to any criminal citation which might issue.
