RESOLVED upon the pertinent appeal$ under the Zoning
Code, by Phillips htroleum. Company and St. Paul Real Estate
Company, owners of the subject real estate, situate in the
City of Saint Paul, located at the northeast corner of Jackson
Street and Maryland Avenue, more partircularly described as
Lots' 1 2� 3, 28 Block 1, Raisonys Addition to St. Paul,
partially zoned In Commercial District and Light Industry
District and partially zoned in "B" Residence District, under
said Zoning Code, that the provisions of said Zoning Code
hereby ar determined and varied, as and to the extent necessary
therefor land that a special permit hereby is granted for the
extension of the Commercial District use presently permitted
on a portion of said'hereinabove described real estate to all
of Lot 3, Block 1, Ranson1 s Addition to St. Paul; and be it
FURTHER RESOLVED that said Phillips Petroleum
Company and St. Paul Real Astate Company be permitted to
install and operate a new gasoline filling station on said
hereinabove described real estate, in accordance with final
plans dated December 4, 1964; subject to the condition that
said appellant - applicant, and their successors and assigns,
otherwise, shall make due compliance with all applicable
provisions of municipal ordinances state statutes and rules
and regulations of public authorities having cognizance.

Dear Sir:
This is in reply to the-referral of Phillips-Petroleum Company and
St. Paul Real Estate Company's 1) appeal for extension of commercial
use to the entire site, and 2) application for a permit to install
and operate a new filling station on property located at the north -
east corner of Jackson Street and Maryland Avenue which is described
as Lots 1, 2, 3, 28, Block 1, Ranson's Addition.
The Property is zoned commercial and light industry with the ex-
ception of the souther yet of Lot 3, Block 1, Ranson's
Addition which is zoned "B" residence. Because of the residential- -
classification of this portion of the site, it is required that
the applicant secure Council approval before proceeding with the
development of the site as proposed.
The Board of Zoning considered this matter at its regular meeting
on November 5, 1964. The staff reported that the proposal met the
- standards for this type of facility.and has also been approved by the
Traffic Engineer. It was pointed out that the "B" residentially
zoned property constituted only 8:26% of the entire tract, and that
the request for an extension of commercial use "was reasonable and in
keeping with the purpose and intent of the Code. It was, therefore,
the Board of Zoning's recommendation that the appeal for an ex-
tension of commercial use to all of Lot 3, Block 1, Ranson's Addition,
and the permit to install and operate a new filling station on the -
above described property be approved in accordance with final plans
dated December A, 1964. �

We have investigated the plans and report that this
installation is done in accordance with the rules and regulations
of the National Board of Fire Underwriters and the St. Paul Fire
Prevention Code.

Gentlemen:
I am appealing for an extension of continued
use for the south 15 feet of Lot 3, Block 1,
Ransom Addition to City of St. Paul. This
will be used in connection with a filling
station to be erected on lots 1,2,3 and 280
Ransom Addition, for Phillips Petroleum Coe
This 15 feet is the only land between "new"
Maryland and "old" Maryland, which is not
zoned commercial. All the property to the
East is Industrial or Light Industrial.
