An ordinance amending the Zoning Code,
Chapters 60 to 64, inclusive, of the Saint
Paul Legislative Code, pertaining to Use
Districts, Height Districts and Rezoning
of certain properties in the City of Saint
Paul, as amended. This is'an emergency
ordinance rendered necessary for the pre -
servation of the public peace, health and safety.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section. 1. That the Zoning Code, Chapters 60 to 64,
inclusive, of the Saint Paul Legislative Code, pertaining to
Use Districts, Height Districts, and Rezoning of certain pro-
perties in the City of Saint Paul, as amended., be and the same
is hereby further amended so as to rezone the following des-
cribed property from "A "1 Residence District to Commercial
District, to -wit:
"Lots 3 and 4, Block 18, Beaver Lake Heights ;tl"
situate on the south side of Stillwater Avenue between Hazel
Street and Algonquin Avenue in the City of Saint Paul.,
See. 2. This ordinance is hereby declared to be
an emergency- ordinance rendered necessary for the preservation
of the public .peace, health and safety.
Sec. 3. This ordinance shall take effect and be
in force upon its passage, approval and publication.

Dear Sir:
This is in reply to the referral of the petition of James.A.
Hayes to rezone from "AI' residence to commercial district
property located on the south side of Stillwater Avenue be-
tween Hazel Street and Algonquin Avenue which is described
as Lots 3 and 4, Block 18, Beaver Lake Heights A4d4 biwr
On December 17, 1964, the Commissioner of Finance reported
-the petition sufficient with the owners of 11 of a possible
13 (.84.617o) tracts of land within the prescribed 100 foot
radius having signed the petition. As stated in the petition,
the purpose of the rezoning is to permit the installation
and operation of a parking lot to serve the commercial use
adjoining to the west.
The Board of Zoning considered this matter at its regular
meeting on January 7, 1965. The staff reported that the
proposed rezoning is in accordance with the Comprehensive
Plan and would, in effect, be an extension of the existing
commercial zoning to the west. In consideration of these
factors, the Board of Zoning recommends the granting of the
petition to rezone the above described property to a commer-
cial district.
