3 WIIEREAS, adverse action was initiated against the T�icab Driver license renewal application

WHEREAS, the licensee did respond to the Notice of Intent to Deny Tasicab Driver License
Renewal Application to contest the allegation; and
WF-IEREAS, the Norice of Intent to Deny Tasicab Driver License Renewal Application stated that
if the licensee failed to contest the allegation by Apri124, 2006, that the matter would be placed on the
consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, that the Tasicab Driver license renewal application submitted by Scott E. Barton is
hereby denied.

NOTICE OF INTENT TO DENY TAXICAB
DRIVER LICENSE RENEWAL APPLICATION

Dear Mr. Barton:
The Office of License, Inspecfion and Environmental Protection has recommended denial
of the TaYicab Driver license renewal application submitted by Scott E. Barton for the City of
Saint Paul. The basis far the recommendation is as follows:
On March 16, 2006, you were sent a letter from the Office of License,
Inspection and Environmental Protection stating that according to the
Department of Public 5afety records your Minnesota Driver's license was
suspended effective October 31, 2005 for failure to pay child support.
This is in violation of St. Paul Legislative Code Chapter 376.16 (e) (1) which
states "Eligibility to be licensed to operate a taaicab shall be as follows: (1)
possess a valid Minnesota Driver's license."
At this time you have three options on how to proceed:
If you wish to have a public hearing befare the Saint Pau1 City Council, you will need to
send me a letter with a statement admitting the facts and requesting a public hearing. We
will need to receive your letter by Monday, April 24, 2006. The matter will then be
scheduled before the City Council for a public hearing to determine whether to revoke
your license. You will have an opporhuiity to appear before the Council and make a
statement on your own behalf.

2. If you dispute the above facts, you can request a hearing before an Admiuistrative Law
Judge. At that hearing both you and the City will be able to appeaz and present
wifnesses, evidence and cross-examiue the other's witnesses. The St. Paul City Council
will ultimately decide the case. If this is your choice, please advise me no later than
Monday, Apri124, 2006, and I will take the necessary steps to schedule the
adwinistrative hearing.
3. If you no longex wish to do business in the City of Saint Paul, you may send a written
statement ta that effect to Christine Rozek in the Office of License, Inspections and
Environmental Protection, 8 Fourth Street East, Suite 200, St. Paul, Minnesota 55101-
1002 tto later than Monday, April 24, 2006.
If I have not heard from you by fhat date, I will assume that you are not contesting
the denial of your license renewal application.
