� WHEREAS, Emerald Street LLC, Zoning File # 05-219-224, has submitted for City Council

NOW, THEREFORE BE IT RESOLVED, that the City Council accepts and approves the attached
Registered Land Survey for Emerald Street LLC to create 3 tracts for a mixed use development,
subject to the condition that the applicant shall file a copy of the Council Resolution approving the
RLS with the Ramsey County Recorder's Office.

A. PURPOSE: Su6division (Combined RLS) to create 3 tracts for a mixed use development
B. PARCEL SIZE: The parcel has 53,900 sq. ft. with approximately 208 ft. of frontage on University
Avenue.
C. EXISTING IAND USE: `The Metro" residential development is under constniction
D. SURROUNDING LAND USE:
North: KSTP Broadcasting and business park (11)
East: Office building (I1)
South: Muitipie family residential developments (Emerald Gardens, 808 Berry Place) (11)
West: University of Minnesota property occupied by Minnesota Geological Survey (11)
E. ZONING CODE CITATION: §69.705 states that "all registered land surveys that constitute a
subdivision as defined in this chapter shall be sublect to the provisions herein contained". §69.406
provides criteria for review of subdivision applications.
F. HISTORY/DISCUSSION: This property was rezoned to TN3 in early 2005 (File # 04-197-781) for
the multipie family development under construction, and a conditional use pettnit was approved for
a building 66 ft. high (File # 05-059-330). A site plan for the project was also approved in 2005
(File # 04-987-567).
G. DISTRICT COUNCIL RECOMMENDATION: The District 12 Council had not commented at the
time this staff report was prepared.
H. FINDINGS:
§69.406 of the Zoning Code requires that all of the following findings shall be made prior to
approval of a subdivision:
(9) A!I the applicable provisions of the Legrslative Code are complied with. This finding is met.
City staff have reviewed the proposed subdivision and have determined that all applicable
provisions of the City Code are met.
(2) The proposed subdivision will not be detrimenfal fo the present and potential surrounding land
uses. This f+nding is met. The proposed RLS will not be detrimental to present and future use
of the surrounding land and is consistent with previous city action for this site.
(3) The area surrounding the subdivision can be planned and deve(oped in coordinafion and
compafibility with the proposed subdivision. This finding is met. The site and the area
surrounding the proposed RLS is atready devetoped or redeveloped.
(4) The subdivision is in conformance with fhe Comprehensive Plan. This finding is met. The Land
Use Plan supports fhe devetopmenf associafed with this subdivision as a high density
residentiai development along the University Avenue transit corridor,
(5J The subdivision preserves and incorporates the site's important existing natural feafures
whenever possible. This finding is met. The site is in a fully developed area of the City. There
are no remaining naturat feafures on this site that wifl be disturbed by the RLS.
(6) All land intended forbuilding sites can be used safely without endangering residents by peril
from floods, erosion, confinuouslyhigh watertable, severe soil conditions orothermenace.
This finding is met. The site is flat with stable soil conditions.
(7J The subdivision can be economically served w"rfh public facilities and services. This finding is
met. The site is already economicaliy served with pubiic facilities from the surrounding
streets.
i. STAFF RECOMMENDATION: Based on required findings 1 through 7, staff recommends approval
of the Preliminary and Final RLS to create 3 fracts for a mixed use development subject to the
condition that the applicant shall file a copy of the Council Resolution approving the RLS with the
Ramsey County Recorder's Office,
