RESOLVED, upon the pertinent appeal, under the Zoning Code,
by Capitol Mortgage and Investment Company, owner of the subject
premises, zoned in "C" Residence District, under said Zoning
Code, located on property at the southeast corner of unimproved
Western Avenue and Ramsey Street, more particularly described
as Lots 20 through 24, Block 2, Whitacre, Brisbine & Mullenrs
subdivision of Lots 1 & 2 of Leechrs addition of Outlots to the
town of Saint Paul according to the plat thereof on file and
of record in the Office of the Register of Deeds in and for
Ramsey County, Minnesota, that the provisions of said Zoning
Code, in respect to density and land area requirements, hereby
are determined and varied, in their application to said real
estate, as and to the extent necessary therefor, and that a permit
hereby is granted unto said applicant, and its successors and
assigns, in respect of said real estate, for the erection of a
36 -unit apartment development to be constructed on the above
described real estate; and be it
FURTHER RESOLVED, That said Capitol Mortgage and Investment
Company hereby is permitted to install and operate a 36 -car
off- street parking facility accessory to said proposed apartment
development on the above described real estate, in accordance
with final plans dated as revised, November 19, 1964; subject
to the condition that the adjoining public alley be improved
from app lieantts west property line to Oakland Avenue, said
improvement to be in accordance with Public Works plans and
specifications; further subject-to the condition that said
applicant- permittee, and its successors and assigns, shall make
due compliance with all applicable provisions of municipal
ordinances, State statutes and rules and regulations of public
authorities having cognizance.

Dear Sir:
This is in the matter of the Capitol Mortgage and Investment Co;'s 1)
appeal to relax the density standards of Chapter 60.24 of the Legislative
Code to permit a 36 unit apartment development on a site of insufficient
lot area, and 2') an a pplication-for-a 36 car off - street, parking lot access-
ory thereto on property located at the southeast "corner of unimproved_
Western Avenue and Ramsey Street which is described as Lots 20 tbru 24,
Block 2, Whitacre,, Brisbee,and Mullins_Sub. The property is zoned "C'1
residence.

The subject property has a frontage of 246•15 feet on the south side of
Ramsey Street and 123.4 feet on'the;e,ast side of,umimproved Western Avenue
resulting in a site area of 30,379 square feet.- Cbapter 60.24 of the
Legislative Code,requires,an area of 36,600 square feet for a36 unit
apartment development and the,applican_t's property is 6,221-square feet
short of the requirement. Therefore, it is'necessary to secure Council
approval before proceeding with this proposal.
The Board of Zoning considered fb is`matter_�at its' regular meeting on Dec-
ember 3, 1964. The staff .reported that the site has some unique character-
istics due to its topography and relationship to adjoining streets. The
Traffic Engineer and Planning_ Board staff reviewed the proposal and it
is their recommendation that tbe'parking lot be approved only on the con-
dition that the adjoining public alley be improved from the applicants
west property line to where it`meets Oakland Avenue and in accordance with
Public Works plans and specifications. It is the recommendation of the
staff, in which the Board concurs,�tbat the density standards should be
maintained limiting -the development of said property to not more than 29
apartment units. Therefore, the Board of Zoning recommends the denial'of
the appeal, and approval of the application for off-street parking for 36
cars on the above described property subject to the above mentioned im-
provement of the alley and in accordance with final-plans dated as revised
November 19, 1964.

to exceaive costs of construction and lack of financing the project
