COMMISSION
Resolved, That the proper officers of t'e City of Saint haul are hereby
authorized tc pay to Ashbach Construction Com any on Partial Estimate No. 4,
Contract No.. L- 6170 -26, also known as Grading and Paving SHEPARD ROAD from
West Seventh Street Boulevard to Davern Stree and MISSISSIPPI RIVER BOULEVARD
from West Seventh Street Boulevard to the Eas Line of Section 21, said
Estimate being for the period of November 15, 1964 to January 1, 1965, and
such other partial estimates on said contract that may be presented subsequently
by said Contractor and approved by the City E gineer, it being the understanding
of this Council that such partial payment or payments on partial estimate or
estimates in no way is to be construed as an Ict -by the City or any of its
agents, servants or employees, extending the time specified for completion or
in any way changing the terms of said contract, plans or specifications thereof,
nor in any way or by any means shall this Resolution or payments eta peymen
made under authority of this Resolution be construed as a waiver of any of the
rights of said City under said contract; and rovided that prior to payments
of any of thl aforesaid partial estimate or a timates; said Contractor, by its
duly authorised agents or corporate officers, shall file with the City Comp-
troller, in form approved by the - Corporation Counsel, an acceptance of the
conditions o, payment as hereinbefore set for h; and be it
Resolved Further, that in the absence o said acceptance being filed
with the Comptroller, no payment or payments,1as aforesaid, shall bemade.
