A public hearing having been had upon the taking and condemnation of the lands or easements
therein, for the above improvement, and the award of damages therefor, and also upon the assessment
of benefits therefor, and the Council having duly considered the same, now therefore be it
Resolved, That the taking and condemnation of the lands described in the annexed assessment roll,
identified by the signature of the Commissioner of Finance, and made a part hereof, and the awards of
damages to the owners of such lands for said taking and condemnation as set forth in said assessment
roll, be and the same is hereby in all respects ratified and confirmed.
Resolved further, that the said assessment of benefits, be and the same is hereby in all respects
ratified, and the same is hereby ordered to be submitted to the District Court for confirmation.

The Commissioner of Finance hereby reports:
That he has fixed and determined the value of the land, lands or easements therein taken and ap-
propriated for the above improvement and the amounts of the awards of damages therefor to the own-
ers thereof, and the persons to whom such awards are payable; that he has also fixed and determined
the amount of benefits to property, from the making of said improvement, not exceeding the cost
thereof, and that attached is an assessment roll entitled as above and identified with the signature of
the undersigned, containing the undersigned's finding on said matters.

Open, widen and extend SHEPARD ROAD from Otto Avenue to Interstate 35E by condemning
and taking the following described property. Together with all right of access being
the right of ingress to and egress from all that portion of the tracts described be-
low, not acquired herein, to the Shepard Road.
Commencing at point being the south corner of Block 1, Riverside Addition No. 2;
thence bearing south 40 °40' east along the southwesterly line of Riverside Addi-
tion No. 2 a distance of 14.0 feet to the point!of beginning of the property to
be described;'thence bearing south 32 °32' west a distance of 125.0 feet; thence
bearing south 11 °41' west a distance of 77.35 feet; thence bearing south 32 °51'
west a distance of 44.75 feet; thence bearing south 43 °08' west a distance of
200.0 feet; thence bearing south 20 °20' west a distance of 101.0 feet; thence
bearing south 69 °40' east a distance of 90.65 feet; thence bearing north 37 041'

feet; thence on tangent to said curve a distanceiof 457.24 feet; thence deflect
left along a 3 °11' curve (delta angle 22 °001) a distance of 691.15 feet; thence
on tangent to said curve a distance of 53 feet to the point of beginning of the
line to be described; thence continuing on last described line produced a dis-
tance of 335 feet and there terminating; except that part northeasterly of a
line parallel to and 25 feet more or less from a line bearing northwesterly at
an included angle of 20 °20' with the north line of the south 600 feet of Govern-
ment Lot 1; where said north line intersects a line 500 feet southwesterly from
and parallel with the southwesterly line of Riverside Addition No. 2 being part
of Government Lot 1, Section 14, Township 28, Range 23.
Also taking a permanent easement for the construction and maintenance of a public
storm sewer on, under, across and through the following described property:
Subject to opening for Shepard Road as described above, a 30 foot wide strip of
land lying 15 feet on either side of a line run from a point on the south line
of Government Lot 1, 570 feet east of the southwest corner of said Government
Lot 1; thence bearing southeasterly along a line at an included angle of 43 °00'
to the Mississippi River.
A strip of land 30 feet in width lying adjacent to and 15 feet on either side of
a line 395 feet southwesterly from and parallel to the southwesterly line of
Riverside Addition No. 2; northwesterly of Mississippi River and southeasterly
of Shepard Road'as opened above.
Also condemning and taking a temporary easement for construction purposes in the fol-
lowing described land:
That land lying within the following described lines: Beginning at the point of
intersection of the south line of Shepard Road as opened above and the south line
of the north 780 feet of Government Lot 2; thence bearing easterly along said
south line of the north 780 feet of Government Lot 2 a distance of 90.0 feet;
thence deflect to the left at an included angle of 43 °12' a distance of 930.0
feet; thence deflect to the left at an included angle of 22 °00' a distance of
425.0 feet; thence deflect to the left at right angles to last described line
to the southeasterly line of Shepard Road; thence bearing southwesterly along
said southeasterly line of Shepard Road to the point of beginning.
That land in the north 780 feet of Government Lot 2 lying northwesterly of the
northwesterly line of Shepard Road as opened above and southeasterly of a line
run from a point on the south line of Government�Lot 1 and 467 feet from the
southwest corner of Government Lot 1 to a point on the south line of the north
780 feet of Government Lot 2 at a distance of 410 feet west of the east line of
the Northwest k of Section 14.
That land lying southeasterly of the Shepard Road opening for bridge purposes
described above, northwesterly of the Mississippi River and southwesterly of a
line 500 feet southwesterly from and parallel to the southwesterly line of
Riverside Addition No. 2.
That land lying1within the following described lines: Beginning at the point of
intersection of the south line of Shepard Road with a line 500 feet southwest-
erly from and parallel to the southwesterly line Iof Riverside Addition No. 2;
thence southeasterly on the last described line a distance of 40 feet; thence
deflect to the left at angle of 105 °,for a distance of 170 feet; thence deflect
to the left at right angle to last described line'to the point of intersection
with the south line of Shepard Road as described above; thence southwesterly on
said south line of Shepard Road to the point of beginning.
That land lying within the following described line; Beginning at the point of
intersection of the northwesterly line of Shepard Road with the south line of
Government Lot No. 1; thence along last described line bearing north 90 °00' west
a distance of 80 feet; thence bearing north 38 °00' east a distance of 575 feet,
thence bearing north 6 °00' west a distance of 415 feet; thence bearing .south-
easterly to a point being the most southerly corner of the Shell Oil Company
garage; thence, northeasterly along the southeasterly side of the garage to the
most northeasterly corner of said garage; thence 'bearing northwesterly along the
northeasterly side of the garage a distance of 45 feet; thence bearing northeast-
erly to a point on the southwesterly line of Block 1, Riverside Addition at a
distance of 30 feet northwesterly from the most southerly corner of said block;
thence bearing southeasterly along the southwesterly line of Riverside Addition =
No. 2 to the point of intersection with the northwesterly line of Shepard Road
as opened above; thence southerly along said northwesterly line of Shepard Road
to the point of beginning.

Also condemning and taking all right of altess to Shepard Road being the right of in-
gress to and egress from all that portion of the following described tract of parcels;
