Laws 1963, Chapter read: 22- City BiJ_._ ':o. 5 SAINT PAUL AND RETIREMENT CERTAIN BENEFITS 1963, CHAPTER 851. I THE STATE OF MINNESOTA: 8515 Section 1 is amended to Section 1. /ST. PAUL; CIVIL SERVICE EMPLOYEES; RETIREMENT.? Fub41V_1&1en -sP Notwithstanding the provisions of Minnesota Statutes, Sections 197.45, 197.46, and 197.47, or any other prior statute of the state of Minnesota or charter provision of the city of Saint Paul to the contrary, every employee of the city of .Saint Paul, other than a city officer elected by the people, who is 'in the classified service i or the unclassified service of the civil service of such city and who has attained the age of 72 years on or prior to the effective date of this act must retire from his employment by said city not later than January 1, 1964, and if he attains thelage of 72 in 1964 he shall retire from such employment on the first day of the month next following the month In which he attained the age of 72; if thereafter he attains the age hereinafter stated in the year hereinafter stated or before, he must retire on the first day of January if attaining such age in the prior year and on the first day of the month next following the month in which he attains the age of retirement, to -wit: 71 years of agelin 1965, 70 years of age in 1966, 69 years of age in 1967, 68 years of age in 1968, 67 years of age in 1969, 66 years of age in 1970, and 65 years of age in 1971, or any year thereafter; provided, however, that during the years 1964 to 19FI inclusive, any such employee who has attained the age of 1 n 1* 65 years may elect to retire prom his employment r' by said city except at none _of the foregoing provisions shall! be constraed as amend or repealing the mandatory retirement provisions of any other law applicable to employees of the city of Saint Paul. Laws 1963, Chapter 851, Section 2, is amended to read: I Sec. 2. The city of Saint Paul shall provide to each employee who retires under the conditions of section 1 or who was compelled, on or after December 31, 1963, to retire under mandatory retirement provisions of any law applicable to employees of the city of Saint Paul, without expense to such employee individual, during retirement, or to the surviving spouse of any such employee or foric r employee, insurance protection in such amounts as the city council may deem proper, providing medical and surgical benefits and hospitalization benefits, all for the employee and dependent spouse. Such benefits shall not exceed at any time benefits of similar nature as authorized to employees of the city of Saint Paul. For such benefits for each i retired employee, the average monthly premium cost shall be limited. to $14 and in addition the monthly premium cost s1wall be limited to 2 I 1,26 -64 5 • i10 for the spouc of such employee. The said city, for the purpose of providing such benefits, is hereby authorized and empowered) by fesolution of its governing body, in addition to and in excess of 4ny limitation upon the amount it is otherwise authorized by law to bevy as taxes, to levy annually a tax not in excess of two- tei4ths -e9 �ee 1-25/100 mill in any one year, upon each dollar of the assessed valuation thereof, upon all taxable property in said city, exclusive of moneys and credits, which taxes as levied shall be spread upon the tax rolls, and collections thereof shall be paid into the treasury of said city, therein to be expended by said city in for no other purpose. Sec. 3. Laws 1963, Sec. 3. Sec.` 4. After the effective date of this section, the city of Saint Paul shall provide to every employee of the city of Saint Paul, other than a city officer elected by the people, who is in the classi- fied service or the unclassified service of!the civil service of said city, and who has been employed by said city for not less than ten .years of regular, full -time service, and who thereafter because of injury or illness is separated from'employment with the city and to the surviving spouse of any such employees the same benefits as are provided by section 2 hereof to the employee and the surviving spouse of an employce Who retires under the conditions of section 1 hereof. Likewise, the surviving spouse of an employee who dies after separation from cityiem�loyment which entitled him, prior to death, to benefits under this section shall be entitled to the same benefits under this law to which the deceased former employee would have been entitled. Sec. 5. If any provisions of Laws 196'3, Chapter 851 and of ti Act or the a tion thereof to an erson!_ or circumstances held invalid, such invalidity shall not affect other provisions or applications of this Act which can be given effect wthout the invalid provision or application, and to this end the provisions of this Act 0 are-declared to be severable. Thi.s act shall become effective only after its approval by a majority of _the governing body of the city of _Saint Paul, the board of education of.the city of Saint Paul, and upon compliance with the provisions of Minnesota Statutes -1961, Section 64 .021. { i i
