' V BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: Section 1. The county of Ramsey and the city of Saint Paul are authorized and empowered to enter into an agreement providing for the joint construction, equipping and operation of an emergency operating center. The center shall be established for the purpose of providing a reasonably safe, secure and firm building from which the headquarters of the Ramsey county civil defense agency and that of the city of Saint Paul will ,operate in event of a major emergency or disaster. The building or structure gill be basically an underground structure or facility located on lands owned by the city of Saint Paul and upon which is presently located the public safety building of the city of Saint Paul, and-such operating center or i structure will also provide a safe, secure, and firm location for the central operations of police and fire fighting communications network of-the city of Saint Paul 1 and the county of Ramsey. f 1 ', Sec. 2. Immediately upon the passage of this act, the city architect of the city of Saint Paul shall cause to be prepared necessary plans and specifications for the construction and equipping of the building or structure contemplated in section 1. He shall be guided by the purpose as outlined in section 1 and by the advice and counsel of the civil defense departments of the county of Ramsey and the city of Saint Paul,'and by the department of public safety of the city of Saint Paul. When the said plans and specifications have been prepared by the city architect, such plans and specifications shall be submitted to the council of the city of Saint Paul and to the board of county - commissioners of the county of Ramsey for their approval, and upon approval by said',bodies, competitive bids shall be let for the aforesaid construction of the emergency operating center. Sec. 3. Subdivision 1. The building or structure, i including necessary parking facilities for automobiles, a reasonable allowance for moving equipment into the building., and a reasonable allowance for new equipment necessary to - operate the center efficiently and effectively, shall not cost in excess of $170007000, which amount shall include available federal funds. Subd. 2. The city of Saint Paul or the county of Ramsey or both are authorized or empowered to enter into an agreement with the United States of America and the state of Minnesota providing for participation in the construction, equipping and operation of the emergency I operating center on such terms as may appear to be,just and reasonable to the governing bodies and approved by the civil defense director of the state of Minnesota and the I , 2 I appropriate agency of the United States of America as i authorized by act of congress. Itlis contemplated that such agreement will provide generally for the payment of I one -half the total cost of the center from the federal treasury and one -half by the joint participation of the city of Saint Paul and the county of Ramsey pursuant to subdivision 3 hereof. Subd. 3. Of the total amount of cost of construction finally established, the share of the city of Saint Paul and the county of Ramsey shall be divided, with the city of Saint Paul contributing 71 per cent and the county of Ramsey 29 per cent. The dollar amount shall-be determined by the county auditor of Ramsey county upon information furnished him by the city comptroller of the city of Saint Paul. Subd. 4. Upon the approval of the plans and specifications by the council of said city and by the board of-county commissioners of Ramsey county, said board ' of county commissioners is hereby authorized to levy a'tax and to collect and expend the proceeds thereof for the purposes of.this act in an amount not to exceed $145,000. Such amount is not to be included within or subject to any tax limitation contained in any other charter or statute. Such levy, for the purpose of constructing and equipping said emergency operating center, shall be made only once and may not be divided among taxable years. 1 Subd. 5. For the purpose of procurement of the necessary money for the payment of the city's share of costs and expenses incurred or to be incurred in the constructing and equipping of said emergency operating i center, the city council of the city of Saint Paul is authorized to provide by resolution for the issuance and sale of general obligation bonds of the city of Saint Paul in accordance with the provisions of Minnesota Statutes 1961, Chapter 475, in an amount not.to.exceed $350,000. Such bonds may be issued and sold without a vote of the electorate and shall not be included in the net debt of the city for the purpose of any charter or statutory debt limitation, and taxes for the payment. of the-bonds and interest thereon shall not be subject to any statutory or.' charter limitation of rate or amount. Subd. 6. In addition to the tax levies hereinbefore authorized, the city of Saint Paul 'and the county of Ramsey are hereby authorized to levy annually a tax on all taxable real and personal property located in said city and said county, for the purpose of providing necessary funds for payment of the joint city and county costs of , operating said emergency operating - center, and therefor to , collect and expend -the proceeds of;such levy. Such amounts shall not be included within or subject to any tax limitation contained in any other charter or statutory limitation of rate or amount. Subd. 7. All claims paid under this act shall be paid by the city of Saint Paul under usual provisions of its charter relating to public contracts. -The county of Ramsey shall pay its share of such claimsl,to the city of Saint Paul on a reimbursement basis as determined by the county t auditor upon certificate of the city comptroller. Subd. 8. The comptroller of the city of Saint Paul shall receive, deposit and expend any funds received from the federal treasury for purposes of this act. Any income i accruing to the center shall be paid over to and accounted ,r i for by the city comptroller. i Sec. 4. Subdivision 1. The city architect is authorized, with the consent of the city council and the board of county commissioners, to retain the services of independent architects and engineers for such assistance and for such limited purposes as he may deem necessary and expedient to assist him in the construction and equipping of this building or structure. Subd. 2. Upon completion of the plans and specifications for the emergency operating center they shall be submitted for approval to the proper agency of the United States of America and the state of Minnesota for approval. Subd. 3. Upon such approval and in accordance with such plans and specifications, the city of Saint Paul shall cause the building to be constructed in accordance with flaws and charter provisions relating to the construction of public buildings in the city of Saint Paul. Sec. 5. Upon completion of the building and upon certification by the architect of the city of Saint Paul that it has been completed according to plans and specifications therefor, the custodial control thereof becomes ve.sted in the city hall and court house committee established by Minnesota Statutes 11961, Chapter 374.18, as amended. This committee shall exercise control over the building or structure and provide for the general custodial operation and maintenance thereof in accordance with the provisions of laws applicable to said city hall and court house committee. Cost of; custodial operation and maintenance of the building shall be divided one -half to the city and one -half to the county -and included in the 5 A- s f annual budget of the city hall andlcourt house committee as provided by law, subject to reduction by any amount payable therefor from the federal treasury. Sec. 6. This act shall become effective only after its approval by a majority of the governing body of the city of Saint Paul and the governing body of the county of Ramsey and upon compliance with'the provisions of Minnesota Statutes, Section 645.,021. r 1 6 E i 1 6 E
