WHEREAS, the Legislative Hearing Officer recommends that the license application for Wine On Sale, Malt
On Sale-Strong, and Restaurant Licenses by Oscaz Reyes, owner, G33 Robert Street South, be approved with the
following conditions:

Per City of Saint Paul Legislative Code 409.15(a)(2), on-sale wine license shall mean a license authorizing
the sale of wine not exceeding fourteen (14) percent alcohol by volume, for consumption on the licensed
premises only in conjunction with the sale of food.
Per City of Saint Paul Legislative Code 409.15(d), licensee must be able to show that gross receipts are at
least sixty (60) percent attributable to the sale of food.
Licensee will submit to LIEP, annual gross receipts for food and liquor with each yeaz the license is
renewed.
4. Licensee will post signage to direct patrons to restaurant pazking across Robert Street.
5. Restaurant staff will encourage patrons to park in locations designated as parking for this restaurant.
Therefore, Be It Resolved, that the City Council approves this license application with the aforementioned
conditions.

Item for suspension on April 26, 2006: License for Guacamoles
Legislative Hearing Officer Report for Oscar Reyes, Owner, Guacarrioles Mexican
Cuisine, 433 Robert Street South
Oscar Reyes, owner of Guacamoles has applied for Wine On Sale, Malt On Sale (Strong), and
Restaurant Licenses. The wine and malt licenses are considered Class N; therefore, neighbors
were notified. I received one letter by the scheduled response date of March 10, 2006.
The letter was received from Donald G. Coury, owner of Michael's Pizza, 441 Robert Street
South, ne�ct door to Guacamoles. Mr. Coury's only objection was to the customers and
employees of Guacamoles using his parking lot. He further states that the owner of
Guacamoles has a small lot across the street, but it is unusable because it is on a hill with brush
and trees. Lastly, he indicated that Mr. Reyes has empty lots across the street and plans to
build on them this spring. Racquel Naylor, Secretary, called Mr. Coury in order to schedule a
Legislative Hearing in this matter. Mr. Coury made it clear that he did not want to attend a
Legislative Hearing and his only concern is that his parking lot not be used by other customers.
Based on these concerns, I asked LIEP to investigate the parking situation, and they
recommended Conditions 4 and 5 be added to the licenses.
Carlos Garcia-Velasco, Community Organizer for West Side Citizens Organization, 127
Winifred Street West, faxed me a fetter today in which he says that the Land Use Committee
formaily and unanimously supports the owner of Guacamoles in the licenses he is pursuing.
Similarly, Jocelyn Van Toor of West Side Safe Neighborhood Council, 209 Page Street West,
discussed this license with the affected block club. They had no concerns either.
Given the above information, I am recommending that the C+ty Council approve the resolution to
grant the licenses with conditions for Guacamoles.

Our review of your application for a Iicense is in process. Notification has 6een sent to the
community organization and residents of the neighborhood in which you intend to operate giving
them until Fridav, Mareh 10, 2006 to voice any objections to your license application. If no
objections are received, your license will be issued (pending any requiremenu not completely met)
approximately one week past the date given above.
If objections aze received, a hearing wi11 be scheduled before a]egislative hearing officer. You will
teceive notice of the time, place and date of the scheduled hearing ftom Marcia Moermond, the
Legislative Heazing Officer. At that hearing the hearing officer will take testimony from all
interested persons and will make a recommendation to the City Council as to whether the license(s)
should be approved or be referred to an administrative law judge for further review. The City
Council will have the final authoriTy to grant or deny this ]icense application.
Note: The following requirements must be met prior to issuance of your license: 1) Submit
certi5cate of liquor liability insurance. 2) Sign and return the enclosed affidavit
acknowledging the conditions that will be placed on your license. A City of Saint Paul
addressed envelope is enciosed for your convenience.
