Dear Sir:
This is in the matter of the appeal of Roger L. Ginkel and Jacob Dim to
establish a new building line setback of five feet from Winona Street
on property located at the southwest corner of East Winona Street and
Brown Avenue which is described as Lot 1, except the south 218 feet;
Lot 2 except the south 218 feet, and except the west 73.5 feet, Block
61, Brown 6 Jackson's Addition. The property is zoned "A" residence.-
The subject property consists of parts of two lots which have a frontage
of 48 feet along the west side of Brown Avenue and 163.5 feet along the
south side of unimproved Winona Street and resulting in an area of
7,848 square feet. Because of the original platting of the lots in this
block, the subject property would be required to maintain a setback of
approximately 44 feet from Winona Street which would render the lot
unbuildable. It_•is, therefore, necessary that the owner secure Council
approval to deviate from the established 44 foot setback.
The Board of Zoning considered this matter at its regular meeting on
November 19, 1964. The -staff reported--that because of the topography in
-the area, it did not appear Winona Street -could be improved westerly of
Brown Avenue for a distance greater than-approximately 200 feet•,and
therefore only one lot could possibly be affected by the requested set -
back.- The staff reported that the established setback should not be less
than ten feet which was agreed to by the applicant. It was, therefore,
the Board of Zoning's recommendation that the building line setback be
granted at 10 feet from Winona Street for the above described property.

The undersigned, Roger L. Ginkel and Jacob Dim, do hereby appeal
from the Zoning Code of the City of St.Paul.
The legal description of the real estate in the City of St.Paul,
Minnesota, that is the subject of this appeal, is as follows;
Lot 1, except the South 218 feet and Lot 2,
except the South 218 feet and except the West
73.5 feet, Block 61, Brown and Jackson's Addi-
tion, City of St.Paul, Ramsey County,Minnesota,
according to the plat thereof on file and of
record in the office of the Register of Deeds
in andfor said county,
Said real estate is located on the southwest corner of East Winona
Street and Brown Avenue in the City of BE. Paul, =Kne`s'so a.
There is no use being made of said property at the present time since
it is vacant land.
The proposed use of the said property is for a single - family dwelling.
The purpose of this appeal is to permit the construction of a single-
family dwelling facing Brown Avenue with a set -back from the
street line of t genty -Four feet and a set -back from East Winona
Street as a side lot line of five feet.
This appeal is needed because the above described property is a part
of a large lot that faces East Winona Street and East'Wyoming Street,
and under the present City of St. Paul Zoning Regulations the set•
back of a dwelling would have to be fifty -three feet from East
Winona Street, and in order to use said described property as a
lot for a dwelling, it will be necessary to have the set -back from
East Winona Street modified by appropriate City Council action:
Said large lot as above referredto has been divided into smaller
lots facing Brown Avenue and there are presently two dwellings
located on said lot which fact Brown Avenue and have a set -back

of twenty -four feet from Brown Avenue. In order to utilize the
real estate hereinabove described in conformity with the sub-
division of the remainder of said lot, it is reasonable and pru�
dent to have a home built thereon facing Brown Avenue with a similar
set -back. East Winona Street, insofar as the same affects the
above described real estate, has not been opened or graded and it
is likely that it never will be in the future because of the topo-
graphy of the area and the use being made of the property imme-
diately north of said East Winona Street.
The section of the ordinance of the City of St.Paul that is being
appealed from is Chapter 6201.
Attached hereto are two copies of a survey of said premises. il
