1 RESOLUTION TO VOID DEMOLITION PERMITS ISSUED FOR REMOVAL OF GARAGES AND
2 SIDEWALK AT 95-97 LANGFORD PARK WEST
5 WHEREAS, the City of Saint Paul is a pariy to a settlement agreement between Thomas and Kim Holman
6 and Stephen McCarty, dated Sept. 9, 2005, pertaining to the redevelopment of an apartment building at
7 95-97 Langford Pazk West into six condominiums for private sale; and

WHEREAS, as part of that settlement agreement, Mr. McCarty agreed to remove two garages and 110 feet
of public sidewalk on the public right of way along Knapp Street, that had been installed as part of the
redevelopment of the site, and
WHEREAS, Mr. McCarty applied for and received the necessary demolition permits to remove the
garages and the sidewalk, and the City of Saint Paul Department of Public Works expects to let a contract
for sidewalk removal this spring in conjunction with this settlement agreement, and
WHEREAS, the current residents of 95-97 Langford Park West as well as several of their neighbors on
Fulham Street, Knapp Street, Hillside Avenue, and Langford Park, at a public hearing on March 1,
requested that the City Council investigate options to the demolition of the garages and the public
sidewalk, and
WHEREAS, the City was put on notice on March 20, 2006, by the Langford Park Condominium
Association, that it held title to 95-97 Langford Park West, when the city issued demolition permits to Mr.
McCarty, who no longer held title to the property, and
WHEREAS, Langford Park Condominium Association has researched the terms of the settlement
agreement and has discovered that the agreement was never filed with the Ramsey County Property
Records Division, nor were any restrictive covenants placed on the deed to prohibit future development of
gazages on the site or sidewalk on the public right of way, and
WHEREAS, the gazages are well-designed, with building materials and architectural detail which
complement the condominium building, and provide much needed off-street parking in this residential
neighborhood adjacent to a public pazk, and
WHEREAS, the Saint Paul Board of Zoning Appeals had granted the necessary vaziances to construct the
garages, which it determined to be "in the public interest," and these variances were never appealed to the
City Council, and
WHEREAS, the public sidewalk is serving the needs of the entire neighborhood, including elderly and
physically disabled residents as well as school children who walk to St. Anthony Park Elementary School
along this route, and

WHEREAS, if these structures aze demolished, it will be at great cost and waste of labor and building
materials, because the current residents, not bound by any deed restrictions, are free to build new gazages
and install a new public sidewalk at this location, and
WHEREAS, it is in the best interest of the St. Anthony Pazk neighborhood that this matter receive public
attention and that thoughtful people of good conscience seek a resolution that does not involve destroying
structures that immediately can be rebuilt; therefore be it
51 RESOLVED that the Saint Paul City Council requests that the City void all the demolition permits that
52 were issued to Mr. McCarty at 95-97 Langford Park West, when he no longer held title to the property, and
53 be it further

55 RESOLVED, that the City Council advises the current residents of 95-97 Langford Park West and the
56 Langford Park Condominium Association to seek a mutual resolution with their neighbors, Tom and Kim
57 Holman, without further intervention by the City of St. Paul.
