4 WHEREAS, §29311 provides for the granting of variances from the sound level limitations
5 contained in §293.09, upon a finding by the City Council that full compliance with Chapter 293 would
6 constitute an unreasonable hardship on the applicant, other persons or on the community; and

WHEREAS, Festival Partners, LLC, represented by Frank C. LoPresti, Managing Partner, who has
been designated as the responsible person on the application, has applied for a vaziance to allow live
music at Harriet Island Regional Park; and
WHEREAS, applicant is seeking a variance for the hours of 6:00 p.m. to 10:00 p.m. on July 27,
2006, from 6:00 p.m, to 10:00 p.m. on July 28, 2006, from 1:00 p.m. to 10:00 p.m. on July 29, 2006, and
from 1:30 p.m. to 5:30 p.m. on July 30, 2006; and
WHEREAS, if applicant is not granted a variance it will not be able to present the live music; and
WHEREAS, the Office of License, Inspections, and Environmental Protection has reviewed the
application and has made recommendations regarding conditions for the variance; now, therefare, be it
RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to Festival
Partners, LLC, subject to the following conditions:
1) The variance shall be for the hours of for the hours of 6:00 p.m. to 10:00 p.m. on July 27,
2006, from 6:00 p.m. to 10:00 p.m. on July 28, 2006, from 1:00 p.m. to 10:00 p.m. on July
29, 2006, and from 1:30 p.m. to 5:30 p.m. on July 30, 2006
2) All electronically powered equipment used in conjunction with the event shall not exceed
100 dBa, as measured 100 feet from the front of the stage(s)
3) The applicant shall provide personnel and equipment who shall provide continuous sound
level monitoring at all stages and each sound mix between 6:00 p.m. to 10:00 p.m. on July
27, 2006, from 6:00 p.m. to 10:00 p.m. on July 28, 2006, from 1:00 p.m. to 10:00 p.m. on
July 29, 2006, and from 1:30 p.m. to 5:30 p.m. on July 30, 2006

3. Logic Systems is not responsible for cancellation as a resutt of any act of god or other force beyond its control.

I sincerely hope we can find a way to work out a mutualiy acceptable deal to contract for the entirety of the Rib America
2006 schedule. We have enjoyed working with you and your group over the past several years, and we look forvvard to
doing so again this year. As a sidebar, in contrast wiYh other vendors bidding on this project, we own all of the equipment
required to complete this project, without the need for sub-rentais. As such, we are able to guarantee the quality,
availability, and prices of the equipment and staff. Please let me know what I can do to help facilitate that agreement.
