06-374Council File # O(.P ��� Resolution # Green Sheet # 3030216 RESOLUTION OF SAINT PAUL, MINNESOTA Presented 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 Referred To Committee: Date J� WHEREAS;'E�a�er 293 of the Saint Paul Legislative Code was enacted to regulate the subject of noise in the City of Saint Paul; and WHEREAS, §29311 provides for the granting of variances from the sound level limitations contained in §293.�9, upon a finding by the City Council that full compliance with Chapter 293 would constitute an unreasonable hardship on the applicant, other persons or on the community; and WHEREAS, the Riverview Economic Development Association, represented by Chris Romano, Executive Director, who has been designated as the responsible person on the application, has applied for a variance to allow live music at or near 176 Cesar Chavez Street; and WHEREAS, applicant is seeking a variance for tbe hours of 5:00 p.m. to 10:00 p.m. for May 5, 2006, and 9:00 a.m. to 8:00 p.m. far May 6, 2006; and WHEREAS, if applicant is not granted a variance it will not be able to present the live music; and WHEREAS, the Office of License, Inspections, and Environmenta] Protection has reviewed the application and has made recommendations regarding conditions for the variance; now, therefore, be it RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to the Riverview Economic Development Association, subject to the following conditions: 1) 2) The variance shall be for the hours of for the hours of 5:00 p.m. to 10:00 p.m. for May 5, 2006, and 9:00 a.m. to 8:00 p.m. for May 6, 2006 All electronically powered equipment used in conjunction with the event shall not exceed 95 dBa, as measured 50 feet from the stage(s) ��-a�y 42 43 44 45 46 47 48 49 50 S1 52 53 54 55 56 57 58 59 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 77 78 79 80 81 82 83 84 85 86 87 88 89 3) All electronically powered equipment, PA systems, loudspeakers or similar devices shall be turned off no later than 10:00 p.m. on May 5, 2006, and no later than 8:00 p.m. on May 6, 2006.
