WHEREAS, the City of Saint Paul by and through its
Department of Public Works, entered into that particular Contract
with James D. Wolff Construction Company, which contract known
as Project No. 62- S -485B, and numbered as L- 6331 -1, provided
for construction of part of the Broadway Relief Sewer System; and
WHEREAS, said contractor has claimed certain additional
costs and expenses, seeking reimbursement from said City therefor;
and r
WHEREAS, said City has claimed certain set -offs and
liquidated damages against said contractor,
Now, Therefore, be it
RESOLVED, That the aforesaid claims of said contractor
and damages and costs of said City may be determined and compro-
-misbd- by the payment to said contractor of the sum of,$3750.00,
to be paid to said contractor and,its attorney, Edward S. Delaney;
and
RESOLVED FURTHER, That the proper City officers may be
and hereby are authorized and directed to draw appropriate
warrants in the -above amount, made payable as aforesaid, and to
enter into and execute an agreement satisfying and releasing
all claims of said contractor against said City and all demands
of said City for liquidated damages and other costs against said
contractor, said agreement to be in such form as shall be
approved by the Corporation Counsel.
