THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
SECTION 1.
That permission and authority are hereby granted to
Allen I. Nilva and Advance Construction Co., a Minnesota cor-
poration to construct a public storm and a public sanitary
sewer in and through a:eertain perpetual public easement herein
provided to be granted or caused to be granted by said per -
mittees to the City of Saint Paul as a condition precedent
to the effect of such grant of permission and authority
hereunder, such public storm sewer and sanitary sewer to
serve two tracts of 'land described as follows:
Tract 1 - 1280 Davern Street - The West
237 feet of Lot 21 except the South 296.08 feet
and also except the South 312.08 feet of the
West 164 feet of said Lot 21, Snelling Out-
lots and the South part of the West 237 feet
of Lot 22, Snelling 0utlots, measuring
65.82 feet on the west along Davern Ave. and

such public sewers to be constructed in such perpetual public

A perpetual public sewer easement 16.0 feet
in width for the purpose of constructing and
maintaining a public storm sewer and a public
sanitary sewer, on, under, across and through

SECTION 2.
That the Commissioner of Public Works hereby is'authorized
to issue a permit to Allen I. Nilva and Advance Construction Co.
for the construction of such pbblic storm sewer and public
sanitary sewer upon and subject to the following provisions,
terms and conditions:
1. That said permittees shall construct said
sewers entirely at their own expense, under the super-
vision and to the satisfaction of the Commissioner
of Public Works, and in accordance with the plans
and specifications prepareiby him.
2. That said permittees shall pay the cost of
engineering and inspection of said work, and for the
publication of this ordinance.' ,
3. That said permittees Mall properly protect
all excavations made in the streets both day and night
so as to avoid all damage or injury to persons or
property; shall properly fill and tamp said streets to
avoid settling and shall restore said streets to their
original condition.
4. That said permittees, after the inception of
said work, shall prosecute same continuously with
diligence, and fully complete said work to the satis-
faction and approval of said Commissioner on or before
January 1, 1966.-

5. That said permittees expressly agree and under-
take to fully indemnify and hold harmless the City of
Saint Paul, its agents, officers, and employees from any
and all damages, claims, losses, judgments, suits, or
expenses arising out of or occasioned by the'performance

of the work contemplated by this permission and authority.
6. That said permittees shall furnish a bond to the
City of Saint Paul in the sum of $102000 conditioned to
comply with all the terms of this ordinance and to indemnify
and save harmless said City from all liability, loss,
judgments, suits, costs, charges and expense that may
accrue to persons or property occasioned by the making of
the improvement or arising out of the same.
7. That said permittees shall not proceed to coz.-
struct said sewers unless and until said permittees shall
have fully complied with the provisions regarding insurance
and indemnification contained in the City of Saint Paul
Department of Public Works Specifications for Street and
Sewer Construction dated April 1, 1959, Section numbered
1.44 of said Specifications, as amended, applicable to
contractors. For the purposes of this ordinance, the
aforesaid section of said Specifications numbered 1.44, as
amended,-shall be•read as though the word "permittees'
were substituted for the word "contractor" wherever the
same appears in the aforesaid Section 1.44, as'amended.
Said Section 1.44, as amended, of the Specifications
for Street and Sewer Construction iri the City of Saint
Paul is hereby incorporated herein by reference as fully
and as completely as if set forth herein verbatim. Proof
of compliance with the provisions of the aforesaid Section,
as amended, shall be in such form as the Corporation Counsel
of the City of Saint Paul may direct, and the documents
required by the aforesaid Section 1.44, as amended, shall,
after submission to the Corporation Counsel, be filed in
the office of the Comptroller of the City of Saint Paul.
8. That the said permittees shall, within thirty
days after the passage of this ordinance, file written
acceptance thereof with the City Clerk.
9. That said permittees shall, at their own cost
and expense, grant or cause to be granted unto said City
of Saint Paul, by sufficient warranty deed, approved as
to form and execution by the Corporation Counsel such
perpetual public sewer easement for the construction,
maintenance and operation of such public sewers on,
under, across and through that strip of land hereinafter

Dear Mr. Lais:
Attached is the original of a letter signed by Bertram Getsug
representing Allen T. Nilva and Advance Construction Company requesting
to build a public storm and sanitary sewer in an easement to serve
certain described real property located east of Davern Avenue and
about opposite Field Street. The exact description of the property
that will be served by the sewer is indicated in the letter.
The descriptions of the sewers to be built are as follows:

Dear Commissioner:
I hereby request on behalf of Allen I. Nilva, 2227 University Avenue,
that the St. Paul City Council pass an ordinance to permit Allen I. Nilva and
Advance Construction Co., contractor, to construct a public sewer privately.
Said sewer is as follows: Sanitary and storm sewer to connect with existing sewer
facilities on Davern Street, which sewer extension is necessary to the construction
of two apartment buildings being located at 1280 and 1290 Davern Street, St. Paul,
Minnesota.

Tract 1 - 1280 Davern Street - The`West 237 feet of Lot 21 except
the South 296.08' feet and also except the South 312.08 feet of the
West 164 feet of said Lot 219 Snelling Outlots and the South part of
the West 237 feet of Lot 22, S,nelling,,Outlots, measuring 65.82 feet on
the west along Davern Ave. and 64.42 feet along the east side of said
West 237 feet.
Tract 2 - 1290 Davern Street - The North 141.0 feet of the South
312.08 feet of the West 237 feet of Lot 219 Snelling Outlots, except
the North 16.0 feet of the East 73 feet thereof, and also except the
North 50 feet of the South 221.08 feet of the Wes150 feet of said Lot
21.
We agree to convey to the City of Saint Paul by deed or such form of
conveyance as may be required a perpetual easement across a strip 8 feet in width
and 90 feet long in each of the tracts with total easement width of 16 feet. The
exact legal description of the easement will be prepared by the surveyor, however,
we are enclosing herewith copy of plat of survey with the area of the easement
identified in pencil. i
We agree to fully reimburse the City for all costs that your department
incurs for engineering and construction inspection.. We also agree to pay the
publication costs for the ordinance.
The undersigned do intend to comply with all the requirements of the
ordinances and understand we must file with the City Clerk a written acceptance
of the terms of the ordinance within the time specified. `We have already received
building permit -and are proceeding with the construction and therefore will appre-
ciate the expeditious processing of this request.
