Dear Sir:
This is in the matter of the appeal of G. R.� Struck to 1) establish a
12 foot building line setback f rom W. Lynnhurst Avenue and 2) to relax
the density standards to permit 34 apartment units to be constructed
on a site having an area of 33,000 square feet, and 3) his application
for a 37 car off-street parking lot in conjunction with the proposed
apartment development which was referred to the Board of Zoning for re-
commendation. The subject property is located on the west side of W.
. Lynnhurst Avenue between Feronia and Oakley Avenues and iscbscribed as
follows; all of Lots 115, 116, 117, 118, 119, and all that part of
Lot 114 described as follows: beginning at a point where the boundary
line between Lots 114 & 115 intersect Lynnhurst Avenue W. thence SWly 40
feet on the west line of said Lynnhurst Ave. W., thence NWIy to a point
2.83 feet east of the NW corner of said Lot 114, thence Ely 11.17 feet on
the rear line of said Lot 114 to the NE corner of said Lot 114, thence
SEly along the Nly line of said Lot 114 to the point of beginning; Union
Park Addition.
A .part of the subject property has recently been developed with an 18
unit apartment building and thereis also a large, old residence which will
' be removed for the purpose of erecting the second apartment building.
(16 units) . The two buildings will be provided with off-street parking
for 37 cars. This is an irregularly shaped tract of land having a combined
f rontage of approximately 283.5 feet along the NWIy side of W. Lynnhurst .
avenue and results in a total site area of approximately 33,000 square feet.
Chapter 60.24 of the Legislative Zoning Code requires that 1,000 square
feet of ground area be provided for each apartment unit, and inasmuch as
the applicant is short of tbis requirement, he is required to secure Council
authorization to build 34 units. He does qualify for a 33 unit development.
He is also requesting a 12 foot building line setback for the proposed build-
ing which would apply in this case to Lot 115.
The Board of Zoning, at its regular meeting on January 9, 1964 after hearing
a favorable report by the Planning Board staff and Traffic Engineer.*;s office,
recommended to concur in the finding to grant the appeals as requested and
the off-street parking facility for 37 cars as reflected in the applicant's
plan dated received February 19, 1964.

There is presently pending certain applications of Gordon

permit and variances respecting proposed construction of apartment
building on Lynhurst Avenue, which applications are now being re-
viewed by the Zoning Board. These applications have been reviewed
by members of the staff of the Planning Board and such review has

We should like to go on record in opposition to the application of G. R. Struck, your File
16295. We are opposing his application for the following reasons:
Since the construction of an apartment house by G. R. Struck directly opposite our
property, we have not i ced a f lood i ng cand i t ion onto our property that had never
existed before, and we have continuously occupied this property since September
of 1951 a
The reason for this flooding condition in our opinion, is that the contour of the �
land was changed in the process of construction to provide a slope in the direction
of our property. This matter was called to the attention of the Department of .
Streets and Alleys and Mr, Struck was brdered to provide a curbing on his property
and to leave the alley in the same condition as it was before construction opera-
tions began. The curbing was installed, but the level of the grade of the alley was
not restored to its previously existing condition.
In spite of the fact that we have had relatively little moisture thus far this winter,
we notice that far more water has collected on our property than has been there
in other seasons. If we have only an average amount of moisture �in the Spring, we
wi I I have a situation where a warehouse on our property wi I I be under several feet
of water. Tliis will either ruin the cbntents of the warehouse or will force us to
spend in excess of $2,000.00 to raise the level of this warehouse above the level �
of the wciter that wi I I col lect there.
Therefore, we respectfully request that the application be denied unless the applicant agrees
to remedy the condition above referred to within d reasonable time, which condition to be
conta i ned i n the order. �
