THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: ,
Section 1. That the Zoning Code, Chapters 60 to 64, inclusive,
of the Saint Paul Legislative Code, pertaining to Use Districts, Height Dis-

be and the same is hereby further amended so as to rezone the following described

approved as to form and execution by the Corporation Counsel,
an easement in common for vehicular and pedestrian travel pur-
poses over the south 12 feet of the hereinabove described real
estate, exercisable by the owners of said real estate and the
owners of the real estate abutting the same on the south, in
/ perpetuity, and that a certified copy of the same shall be filed
with the City Clerk within the period of 30 days next succeeding
the publication of this ordinance.
Section 2. This ordinance is hereby declared to be an emergency ordinance
rendered necessary for the preservation of the public peace, health, and safety.

The City Council requested that you draw an ordinance rezoning
the property described in the attached petition and letter, but subject
to the requirement that the petitioner and any other property owner involved
shall give the City easements for access to residential property on Englewood
Avenue.
We are not sure how this matter of providing access should be
handled, and suggest that you confer with B. R. Teig, City Planner, or
one of the engineers in Public Works. The-Council's idea, apparently,
is to provide access to garages for the residents on Englewood Avenue.

Dear Madam:
This is in reply to the referral of the petition of Cleon Garley and
the Hartwig Corporation to the Board of Zoning for a recommendation
on the advisability of rezoning from "B" to 11C" residence district pro-
perty located at the southeast corner of Pierce Butler Route and Victoria
Street and which is described as Lots 16, 17, 18, 19, 20 and 21, Block 6,
except the Nly 40 feet thereof, Winters Addition.
On January 15, 1964, the Commissioner of Finance reported the petition
sufficient with the owners of 7 of a possible 10 (707o) trads of land
within the prescribed 100 foot radius having signed the petition. The
subject property is now vacant and approximately three feet above the
street grade of Pierce Butler Route. It is proposed, as stated in the
petition, to develop the site with a 22 unit apartment building. The
property is rectangular having a frontage of 234.7 feet along the south
side of Pierce Butler Route and a depth of 94.3 feet, resulting in an
area of approximately 22,132 square feet.
The Board of Zoning considered this matter at its regular meeting on
January 23, 1964 and concluded that this proposal would provide a
proper transitional use between the residential uses to the south, and
the industrial character of the properties to the north and west and
therefore, recommended the granting of the petition to rezone the above
described property to the requested "C" residence district.
