The subject property is located on the south side of Stillwater Avenue , between Birmingham Street and Barclay Street extended, and the legal description of the property is attached. This is a rectangularly shaped tract of land with a total frontage of 400 feet along the south side of Stillwater Avenue; 125 feet along the east side of Birmingham Street and 142 feet along its east property line resulting in an area of approximately 52,850 square feet. The applicant makes this request pursuant to Chapter 64.03, Section "1", par. 2 of the Legislative Zoning Code which requires Council authori- zation before the erection of an apartment building for more than four families can take place in an "A" or "B" residence district..
