BE IT I2ESOLVED, that, upon the petition of the Anchor Bank, as documented in Pubiic
Works Technical Services, Vacation File Number 01-2006, the public property hereinafter
described is hereby vacated and discontinued as public property, subject to the herein stated
exceptions.
The property to be vacated is described as follows:
That part of the north - south alley in Block 2, Snelling Park to St. Paul, Minnesota; lying
north of the westerly extension of the south line of Lot 5, Block 2, Snelling Park to St. Paul,
Minnesota.
BE IT FURTHER RESOLVED, that, subject to the herein stated exceptions and with the
accompanying Utility Easement Certificates of Intended Non-Use, filed voluntarily on behalf
of, Comcast, Northern States Power Company, d.b.a. Xcel Energ,y (Gas), District
Energy St. Paul, Inc. and District Cooling St Paul, Inc., MCI Metro Incorporated, St.
Paul Regional Water Services and St. Paul Department of Public Works, made a part
hereof by this reference and filed in the office of the City Clerk of St. Paul, the City, for
itself and on behalf of these corporations and departments, waives the right to the utility
easements in the vacated azea described above.
This vacation shall be subject to the terms and condition of Chapter 130, codified March 1,
1981, of the Saint Paul Legislative Code as amended, and to the following conditions:
1. That the petitioner's, their successors and assigns shall pay $1,200 as an administrative fee
for this vacation which is due and payable within 60 days of t1�e effective date of this
resolution.

3. That an easement shall be retained over the entire azea of the vacated alley on behalf of
Xcel Energy-Electric Division for access and maintenance of its existing facilities.
4. That a permanent utility easement shall be retained within the vacated azea to protect the
interest of Qwest Corporation for its existing cables, until such time that its existing facilities
can be relocated.

harmless the City of Saint Paul, its officers and employees from all suits, actions or claims of
any character brought as a resuit of injuries or damages received or sustained by any person,
persons or pzoperiy on account of this vacation or petitioners use of this property, including
but not limited to, a claim brought because of any act of omission, neglect, or misconduct of
said petitioners or because of any claims ar liability arising from any violation of any law or
regulation made in accordance with the law, whether by the petitioners or any of their agents
or employees.
8. That the petitioners, their successors and assigns shall, within 60 days of the effective date
of this resolution, file with the City Clerk an acceptance in writing of the conditions of this
resolution and shall, within the period(s) specified in the terms and conditaons of this
resolution, comply in a11 respects with these terms and conditions.

This petition is to vacate that part of the north - south alley m Block 2, Snelling Pazk to St. Paul,
