An Ordinance amending the Zoning Code,
Chapters 60 to 64, inclusive, of the Saint Paul
Legislative Code, pertaining to Use Districts,
Height Districts and Rezoning of certain
properties in the City of Saint Paul, as
amended. This is an emergency ordinance rendered
necessary for the preservation of the public
peace, health and safety.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Zoning Code, Chapters 60 to 64
inclusive, of the Saint Paul Legislative Code, pertaining to &e
Districts, Height Districts, and Rezoning of certain properties
in the City of Saint Paul, as amended,.be and the same is hereby
further amended so as to rezone the following described property
from "All Residence to�Commercial District, to wit:
"Westerly 250 feet of the parcel described as:
Commencing at the Northwest corner of the Northeast
1/4 of the Northeast 1/4 of Section 23, Township 28,
Range 22, then Southerly along a line parallel to
the tangent part of the centerline of State Trunk
Highway #61, a distance of 569.8 feet to a point of
beginning, then Southerly along said line 120 feet
to a point, then West along a line parallel with North line
of said Quarter Section to the Easterly boundary of State
Trunk Highway #61, then Northerly along said Easterly
boundary line 120 feet�to a point, then East to a point
of beginning, also described as 1272 South Point Douglas Road.

north of Carver Avenue.
Section 2. T14is ordinance is hereby declared to be an
emergency ordinance rendered necessary for the preservation of the
Public peace, health and safety.
Section 3. This ordinance shall take effect and be in force
upon its passage, approval and publication.

Dear Sir:,
This is in reply to the_referral•of the petition of Eugene Marien to
rezone from "A" residence to commercial-district property located on
the east side of Point Douglas•Road north of Carver Avenue. A legal
description of the property is attached.
On August 16, 1965, the Commissioner of Finance reported the petition
sufficient with the owners of 3 of a possible 3 (100 %) tracts of land
within the prescribed 100 foot radius,having signed the petition.
The Board of Zoning considered this matter -at its regular meeting on
September 2, 1965. The staff reported that in April 1928 the City
Council authorized the issuance of a two -year temporary permit to
install and operate a filling station on the site. Field investiga-
tion discloses that the site is partially developed with a filling
station and partly under cultivation. It is proposed to continue the
filling station use, but with proper zoning. The site has a frontage
of•120 feet along Point Douglas Road and a depth of 250 feet resulting
in an area of 305000 square feet.
All of the properties fronting on Point Douglas Road from Highwood
Avenue to the southern corporate limits, except for the subject
property and one other filling station are developed with single - family
residences or are vacant. The Comprehensive Plan indicates the highest
and best use of the property is the R -1 classification (single - family
dwellings). It was the Board's finding that the rezoning of the pro -
perty would constitute "spot zoning" and be contrary to the Comprehen-
sive Plan Therefore, the Board of Zoning recommends the denial of the
petition to rezone the above described property to a commercial district.
