RESOLVED, upon and pursuant to the pertinent appeal,
under the Zoning Code, by S. M. Burton Company, as owner of the
subject real estate situate in the City of Saint Paul, zoned in
Residence District under said Zoning Coda, and described as
follows, to -wit: Lots 9, 18, 19, 23, Block 74, Dayton & Irviners
Addition, located on the east side of'Western Avenue between
Maiden vane and Laurel Avenue, that the provisions of said
Zoning Code hereby are determined and varied in application,
as and to the extent necessary therefor, and a special permit
hereby is granted unto said appellant and its successors or assigns,
for the construction, maintenance and operation on said premises
of a 120 -bed nursing home, in accordance with final plans dated
October 11 1965; all subject to due compliance with'-all
applicable municipal ordinances, State statutes, and rules and
regulations of public authorities having cognizance.

Dear Sir:
_On November 2, 1965, the City Council referred to the Zoning Board for
further consideration the matter of the appeal of the S. M. Burton
Company to establish a 120 -bed nursing home on property located on the
east side of Western Avenue between Maiden Lane and Laurel Avenue which
is described as Lots 9, 18, 19,'and 23, Block 74, Dayton & Irvine's
Addition.
The Board reconsidered this matter at its meeting of November,4, 1965
and at a continued meeting held on November 9; 1965. At these meetings,
the Board afforded all citizens present the opportunity to be heard.
Between the dates of November 4th and 9th,,members of the Board viewed
the subject property.and the immediate area.
In reconsidering the matter, the Board is of the opinion that the pro-
posed facility appears to be a proper use.in respect to the existing
"C" Residence zoning and the existing land uses in the area. The Board
also considered the Comprehensive Plan which recommends a high density
multi - family district which permits this type of facility. Therefore,
the Board of Zoning voted to reaffirm its prior action and to recommend
the granting of the application to establish a 120 -bed nursing home on
the above- described property in accordance with the revised plans
dated October 1, 1965.

Dear Sir:
This is in the matter of the S. M. Burton Company's appeal to establish a 120
bed nursing home on property located on the east side of Western Avenue
between Maiden Lane and Laurel Avenue which is described as Lots 9, 18, 19, 23
Block 74, Dayton 6 Irvine's Addition. The property is zoned "C" residence.
The applicant is making this appeal pursuant to Section 60.15 of the Saint
Paul Zoning Code which requires the City Council to conduct a public hearing
before the establishment of this type of use. Lots 9, 18 & 19, which are con-
tiguous, are developed with large residences, Lot 23 is developed with a two -
car garage. The applicant proposes to remove the existing structures on the
three adjoining lots and develop - the"site with a three -story 120 bed nursing
home with off - street parking for 14 cars. The fourth lot (Lot 23) is to be
developed with an 11 car employee parking lot. The three adjoining lots have
a frontage on the east side of Western Avenue of 120 feet and a depth of 272
feet which results in an area of approximately 22,1OO'square feet. The separ-
ate lot on Western Avenue is,6O feet by 137 feet which results in an area of
8,220 square feet.
On October 8, 1965, the Board of Zoning met to consider this appeal. The
staff reported that the'area uses - consist basicly of low and medium density
multi - family residential development and quasiL public institutions uses with
the exception of properties`to the south fronting on Summit Avenue which are
developed with single and two- family homes.' The area is- classified "C" resi-
dence with the exception,of properties to the south of Holly Avenue and the
properties fronting on Summit Avenue which arel classified "A" residence. The
proposal is in accordance with the Comprehensive Plan which indicates the
highest and best use of subject .property -to,be in R -8 residential district.
The City Architect's office has determined the minimum setback from Western
Avenue to be 13 feet-and the 'A applicant's plan meets this requirement.
In consideration of the above factors and that the proposed facility appears
to be a proper use in respect to the existing uses and the Comprehensive Plan,
the Board of Zoning recommends the granting of,the appeal to establish a 120
bed nursing home on the above described property in accordance with the
revised plans dated October 1, 1965. The approval of parking lots is an

S.M. Burton Company Realtors for an appeal to erect and operate a
