BE IT RESOLVED, that, upon the petition of the City of 5t. Paul, as dxumented in Real
Estate Division File Number 19-2004, the public properties hereinafter described are hereby
vacated and discontinued as street right-of-way:
I) Curroll Avenue from Lexington Parkw¢y as widened, to 114' east.
2) Iglehart Avenue from Lexington Parkway as widened, to Oxford Street.
3) Subject to Parkway, the alley in Block 2, A.B. Wilgus Addition.
BE IT FURTHER RESOLVED, that, subject to the herein stated exceptions and with the
accompanying Utility Easement Certificates of Intended Non-Use, filed voluntarily on behalf
of, District Energy St. Paul, Inc., District Cooling St Paul, Inc. and Comcast of
St. Paul, made a part hereof by this reference and filed in the office of the City Clerk of
St. Paul, the City of St. Paul, for itself and on behalf of these coiporations, waives the right
to the utility easements in the vacated areas described above.
This vacation shall be subject to the terms and condi6on of Chapter 130, codified March 1,
1981, of the Saint Paul Legislative Code as amended, and to the following conditions:
That easements shall be retained in Carroll and Iglehart Avenues on behalf of Xcel Energy
Gas Division for access and maintenance of its existing facilities. Easement releases can be
considered once existing facilities are relocated or abandoned to the satisfaction of Xcel.
That easements shall be retained on behalf of Xcel Electric to maintain its existing facilities
in Carroll Avenue and the subject alley. Easement releases can be considered once the
removals of the overhead electric distribution facilities are completed.
That easements shall be retained on behalf of St. Paul Regional Water Services (SPRWS) to
access and maintain its existing water main facilities, conditions of the easement are ouflined
in the SPWRS standard easement provisions dated 2/8/2002.

2 That an easement shall be retained in Iglehart Avenue on behalf of the City of St. Paul,
3 Department of Public Works for access and maintenance of its existing sewer facilities. At
4 such time that the sewer is re-routed to the satisfaction of Public Works, only then will
Public Works consider the release of its easement interest.
That an easement for sewer purposes shall be dedicated by the petitioner, its successors or
assigns, to the City of St. Paul, as described in Exhibit "B".

That an easement for sewer purposes shall be dedicated by the petitioner, its successors or
assigns, to the Saint Paul Regional Water Services, as described in Exhibit "C".
That, at the direction of the City of St. Paul, Department of Public Works, the petitioners,
their successors and assigns shall be responsible for all costs and expenses incurred by said
Pubiic Works for the removal of the three street lights on Iglehart, the relocation of the wood
lighling pole on Carroll and relocation of the existing electrical feed point located in the
subject alley (which services lighting on Lexington). Contact the General Foreman for
Public Works Lighting and SignaULighting Maintenance when the subject :ights-of-way are
vacated.
That the owner of the north half of I.ots 1 and 2, Block 2, A.B. Wilgus Addition will convey
any interest it has in Iglehart Avenue to the City of Saint Paul and the City of St. Paul will
accept this conveyance. In return, the City of St. Paul will grant easements for ingress/egress
purposes and vehicular pazking purposes.
That the petitioners, their successors and assigns shall, within 60 days of the effective date of
this resolution, file with the City Clerk an acceptance in writing of the conditions of this
resolution and shall, within the period(s) specified in the terms and conditions of this
resolution, comply in all respects with these terms and conditions.

That a permanent utility easement shall be retained on, over, under and across the vacated area on
behalf of the Board of Water Commissioners of the City of Saint Paul to reserve the right of the
Board to maintain and operate any water faciliry in or upon said easement and to enter upon said
easement, or any portion thereof, at any time and from time to time, for the purposes of future
construction, reconstrucrion, inspection, maintenance or repair of the same, or any part thereof.
Said utility easement shall be subject to the following requirements:
a. No buildings, structures, trees or any temporary shucture, material storage, fixture,
or any other objects which may prohibit normal access to water facilities for
maintenance purposes will be permitted within the easement area.
b. Improvements in or upon the above described easement that do not prohibit the Board
from exercising its reserved rights may be allowed by obtaining written permission
from Saint Paul Regional Water Services with the understanding that the restoration
and costs of such improvements shall be the sole responsibility of the petitioner, its
successors and assigns in the event the Boazd exercises its reserved easement rights.
c. Should it be necessary that the petitioner's works or improvements be removed or
damaged as a result of Saint Paul Regional Water Services operations, all removal,
replacement or modification costs shall be borne solely by the petifioner.
d. No change from the existing grade within the easement azea shall be pernutted
without written permission from Saint Paul Rea onai Water Services.
e. No change in surfacing within the easement area shall be permitted without written
pernussion from Saint Paul Regional Water Services.
The petitioner, its successors and assigns shall fully indemnify, defend, and save
harmless the Board of Water Commissioners of the City of Saint Paul, its officers,
agents, employees, and servants from all suits, actions ar claims which shall arise
from any injuries or dainages received or sustained by any break in any service pipe,
water main, or connection in said reserved easement, arising out of or resulting from
any action or negligence of the peritioner, its employees, agents or, business invitees.
