V�If�REAS, in the matter of Comptroller� s Contract L-6698 for
the Grading and Surfac ing of BATTLE CREEK PLACE from Upper
Afton Road to Cul-de-Sac, V[r. J. Ebertz Company, contrac tor,
the specified date of completion is October 15, 1964, and
VSiL�EREAS, the contractor has prosecuted the work dili�ently,
but due to the encountering of unsuitable subgrade material,
necessitating its removal a�c� replacement with Class 5 Gravelf,
to�ether with thepo'stponement of the seal-coating until more ,
favorable weather during the current construction season, it
was not possible to complete the contract by sai d date of
completion, therefore, be it
RESOLVED, that the proper city officials be and they are hereby
authorized and directed to execute an amendment Fto said contract
extending the time of completion to JUI,Y l, 19��, provided,
however, that this resolution shall have no force or effect
unless the sureties on the Contractor� s bond consent theret o
