RESOLVED,. �.pon the pertinent appeal under the Zoning
Code by Nottingham Investment Co. , as owner of the sub�ect
praperty situate in the City of Saint Paul� described as Lot
15, Block 5� Edwin Dean� s Subdivision of Part of Smith and
Lott's Outlots to the City of St. Paul, Ramsey County, Minnesota,
located on the north side of Marshall Ave. between Avon and Fisk
Streets� that the proYisions of said Zoning Code hereby are
determined and varied in application so that the premises may
contain separate accommodations for several, not in excess of
four families; provided that the con�Ginuance of such four-family
dwelling be for the remaining life of the structure now on said
premises, and provided fia.rther, that the appellant complies with
the changes set forth in the Bureau of Publie Buildings and
Housing Code Division report dated August 25, 1965� and provided
further, that such permission shall lapse ipso facto unless the
anpellant is in full compliance with the above report, dated
August 25� 1965, within one year from the date of this resolu-
tion, and provided further, that the appellant provide a total
of four off-street parking spaces for saicl dwelling, acceptance �
of this resolution and terms to be made by the appella.nt� and

finds that such relief`will be consistent with the public health

, This is written in reply to the referral of the appeal of Nottingham
- Investment Company to legalize and continue a four-family residen-
' � tial use in a "B" residerice district on property located on the north
side of Marshall Avenue between Avon and Fisk Streets. The property
: is legally described as Lot 15, Block 5, Ed. Dean's Subdivision.

, In 1909,- a large 2 1/2 story two=family•dwelling_was constructed on
the site: • I�n�..a-letter dated July 2, 1965, the applicant's attorney
stated that the subject property was converted into a four-plex under
- a building permit issued: by the Building Department, and that the
structure has been`,continually maintained and..occupied as a four-plex
from 1931 to the present. Because the��roperty is classified as "B"
residence which normally limits its;use to single and two-family
- dwellings, the applicant must secure Coun�il authorization to continue
� the use of the property as 'a four'=plex. r �

The Board of Zoning,heard this appeal on September 2, 1965. It was
' reported by the staff that there is :a 'two-car garage on the site and �
that there is adequate space to provide two more off-street parking �
spaces with access from an "unimproved but passable alley. It was the
, Board's finding th at.inasmuch 'as the site can provide four off-street
parking spaces, the appeal to continue the four-family residential use
be granted subject to compliance with the changes set fortli in the
Bureau of Public':Buildings � Housing Code Division report dated
August 25, 1965, a copy of whichais attached, and also subject to the
_ applicant providing 4 off-street parking spaces.

The Board of Zoning recommends" that the use of the subject property
be permitted to continue a"s a four-plex for the life of the structure
� subject to the above conditions. It is also recommended that, should
the Council grant the appeal, a copy of the resolution be filed with

Honorable Sirs:
As attorneys for Nottingham Investment Company, we hereby appeal from
the decision of the Co�issioner of Parks, Playgrounds and Public Build-
ings as regarda his application of the provisions of the Zoning Code to
the above referenced property.
The property was improved with a double house in about the year 1909.
Such use of the property conformed to the "B" zoning classification
thereafter established. In the year 1931, it was converted into a
four-plex, and it has been continually maintained and occupied as such
from 1931 to the present date. The conversion was done under a build-
ing permit (No. 5702) issued by the Building Department in September
of 1931, and was therefore, done with the acquiescence of the City of-
ficials concerned. On the basis of these facts, we respectfully request
that you adopt an appropriate resolution authorizing the ma.intenance of
the four-plex, notwithstanding its situation in a "B" residential dis-
trict. We are of the opinion that such maintenance c�ould not be contrary
to the general welfare of the neighborhood.
We respectfully request your consideration of this matter.
