RESOLVED� upon the pertinent appeal under the Zoning
Code by Carl F. Colburn, as owner of the subject property
situate in the City of Saint Paul, described as Lot 27, Block
1, Bryantts Addition to .St. Paul, located on the north side
of Ashland Avenue between Victoria and Avon Streets, that the
provisions of said Zoning Code hereby are determined and varied
in application so that the premises may contain separate aecommo-
dations for several� not in excess of thr-ee families� provided
that the continuan.ce of such three-family dwelling be for the
remaining life of the structure now on said premises, and provided
further, that the appella� complies with the changes set forth in
the Bureau of Public Buildings and Housing Code Division report
, dated August 24, 1965, and provided further, that sueh permission
shall lapse ipso facto unless the appellant is in full eompliance
with the above report� dated August 24� 1965� within one year
from the date of this resolution� and provided further� that the
appellant provide a total of three off-street parking spaces for
said dwelling, acceptance of this resolution and terms to be made
by the appellant� and subje�t to complian.ee with said provisior�s,
the Council expressly finds tha�G such relief will be consistent
with the public health and general welfare, and that said relief
and permission herein granted is subject to the further condition
that the appellant and hi�s suceessors and assigns otherwise shall
make due eompliance with all applicable provisions of Municipal
Ordinances� State Statutes, rules and regulations of public
authorities having cognizance• further� that a copy of this
Resolution be filed with the �.egister of Deeds in and for Ramsey
County� Minnesota.

This is written in response to the appeal of Carl F. Colburn to - -
� legalize and continue a three-family residential use in a "B" ..
residence district on property located on the north side of
Ashland Avenue between Victoria and Avon Streets. The property is
described as Lot 27, Block l, Bryant's Addition.
In 1886, the property was developed with a �.arge 2 1/2 story frame
�esidence constructed as a single-family dwelling. At some unknown
_date,. the use of the st�ucture was extended to include 3 apartments
and 1 sleeping room unit. Because the property is classified as
"B" residence which normally limits it to the use of two families,
' . �the applicant must secure Council authorization to� continue the use
of the property as a three-plex. ,
The Board of Zoning heard this appeal on September 2•, 1965. The
� � staff reported that there is no off-street parking provided on the
site, but"with access from the public alley, the rear yard is of .
• sufficient size to accommodate the necessary off-street parking
spaces. It was the BoardTs findings that inasmuch as the required .
` off-street parking can be provided, it appears •reasonable to grant
:the appeal to continue the three-family 'use subject to compliance
,with the changes set forth in the Bureau of .Public Buildings and
the Housing Code Divis,ion report,. dated August 24, 1965, a copy of
which is attached, and subject to the applicant providing 3 off- ,
street parking spaces. , � '

It is, therefore, the Board of Zoning's recommendation that the
, a�peal be approved for the contiriued use of the builcling as a three-
plex for the life� of the structure subject to th above conditions.
It is also recommended that, should the Council�rant the appeal, a
copy of the resolution be filed with the deed in 'the Register of

The following is a list of items requiring alteration, repair or
removal to meet the minimum requirements of the Housing Code and
Building Code.
BUILDING This building is pres�ntly occupied with the owner' s
apartment on the first floor and apartments on the �
second floor with two sleeping rooms. However, one
of the sleeping rooms has a gas stove and sink and it
' is the owner' s intention to make this into a kitchen
and apartment� It does not have the necessary 150
square feet required.- Although the front sleeping
room is of sufficient area and if it is the owner' s
desire to have a housekeeping apartment on the second
floor, this room could be converted to that use with
the installation of a kitchen sink and cooking stove.
BASEMENT The boiler room must be enclosed with walls and ceiling
construction having at least a one hour fire rating.
(Elec) Install the proper receptacles in laundry area.
Remove the BX and loom wiring systems and replace with
a wiring system in conduit.
(Plbg) A handwashing lavatory must be installed in the compart-
ment housing the water closet in the basement. This
lavatory must be supplied with hot and cold running
water and properly connected to a sewer.
lst Floor Remove all extension cords in the living room and the
' bedroom.
Install additional wall receptacle in each of the bed-
rooms. Enlarge `the electrical service to one that will
meet the requirements for a three-unit apartment building,
A light must be installed in the rear stairwell to the
se.cond floor so the stairs and hall will r.eceive light
at all times.

2nd Floor Reinstall the kitchen sink in the east apartment so
that it is properly vented, using proper materials for
the piping. Properly install waste piping from the
. second floor to the basement, using proper materials.
' Repair or replace all necessary plaster on the second
floor.
Repair or replace. all cracked window panes and broken
sash cords on the second floor.
EXTERIOR Handrails must be installed on the west steps down to
� the public walk and the rear stairwell from the first
to the second floor.
� Risers on the rear exterior steps are in need of some
repair and the rear porch trim and support should be
repaired,
These are all of the items that our inspectors have indicated.
They have made a notation that the bath in the second floor is in
surprisingly good condition and that the basement toilet is in
working order,
