PAUL FOENCIL NO ` �' OFFICE OF THE CITY CLERK COU CIL RESOLUTION—GENERAL FORM � �RESENTED EY � COMMISSIONE � DA� i 'WHFR.EAS� on the 26th day of April� pursuant to Council File 206762� approved April 12� 1962� the City entered into , an agreement in the nature of a lease of privilege running to Public Pools, Inc. � whereby Publi�c Pools, Inc. undertook to and did construct and operate a pool �i� a portion of the site of the former workhouse buildings within Como Park; and '�THEREAS� Chester Products� Inc. a foreign corporation� recovered a judgment against Public �'ools� Inc. on October 7, 1964, in the a.mo�n.t of �24,404.00 in�the District Court of Hennepin County, which judgment was against Public Pools� Inc. and its individual shareholders� and �in partial satisfaction of said j�.dgment the shareholders transfe�red all their stock to Chester Products� Inc. with the result that Public Pools� Inc. is now wholly owned by Chester Products, Inc. ; and WHEREAS� Chester Products Inc. �and Public Pools, Inc. have offered to sell the Como �'ool to the City of �aint Paul and release all �ight� title and privilege under the Publi� Swimming Pool License Agreement dated April 26� 1962� and all amendments thereto, for the amount of the judgment� but have agreed to accept the sum of �15�000.00; a.nd � '' - � - �iEREAS� The Commissioner of Parks and Recreation and Public Buildings� the City Comptroller and the Corporation Counsel have studied this matter and recommend the acceptance of this transaction on the groun.ds that •the operation of� Como � Pool by a private corporation wholly own.ed by a.n out-of-state ' corporation is not in the best interest of the City; that the � � main purpose of the foreign corporation would not be to operate �► �, a pool� but to satisfy a �udgment; that the lack of local �'� interested supervisors would increase the risk of da.mage and �; deterioration .to the pool and appurtenances; that the private use of the pool after public hours� has in the past, created a noise problem and with lack of proper supervision it is very � likely that said problem wi11 be intensified; that there will � be a greater burden placed upon the Public Safety and Parks - Department supervisory employees by virtue of such operation; COUNCILI�N Adopted by the Council ' 19_ � Yeas Nays • � + Dalglish � Holland ' Approved 19_ i Loss Tn Favor 1 Meredith ` Peters on � MAyOr � - A gainst � Rosen Mr. President, Vavoulis ions e-as , � ! ] � (�((('''���/ \ ORIGINAL TO CITY CL6WK J �(�'J�\� ,-� CITY OF ST.
