� WHEREAS, the Council of the City of Saint Paul has
received a copy of Resolution of the Housing and Redevelopment
Authority of the City of Saint 1au1� Resolution No. 65-6/9-4�
requesting the Council.' s consent to the acquisition, by the
Authority, of the public alley referred to in said Resolution
of the Authority� it being the ir�tention of the Authority� if
the Council of the City of Saint Paul consents thereto, to acquire
said alley through the exercise of eminent domain procedu`res
pursuant to State Statute; now� therefore, be it
RESOLVED:, That the Council of the City of Saint Paul
hereby consents to the acquisiti.on, by the Housing and Redevelop-

Gentlemen:
The Authority has entered a contract to sell the Easterly one third
of Block 12, St. Paul Proper to the Farm Credit Banks of St. Paul. The tract is
bounded by Fifth and Sixth Street on Jackson Street, includes a ten foot north-
south alley over Westerly ten feet of Lots 2 and 13 in Block 12 and a twenty foot
alley over the South 10 feet of Zot 3 and the North ten feet of Lot 12.
The Authority has previously filed a petition to vacate said alley
upon condition of providing temporary access to users of the alley, and, as a part
of the redevelopment of Block 12, installing without cost to the City, a new north-
south alley within the Block.
The Farm Credit Banks have taken bids to construct a three million
dollar office building which must be awarded by July 3 or new bids called for.
Accordingly, the Banks have requested delivery of title and possession to the tract
including the above described alley prior to that date. Because the vacation
proceeding would not be completed until late in July, the Authority commissioners
have authorized a condemnation of the alley under the Authority's statutory power of
superior public use. This power permits the taking of public property provided that
the consent of the Council is given to such taking.
In order to facilitate the prompt undertaking of construction of the
Farm Credit Bank Building, the Authority requests the consent of your Honorable Body
to the taking of the above-described public alley. '
