An Ordinance amending the Zoning Code,
Chapters 60 to 64, inclusive, of the Saint
Paul Legislative Code, pertaining to Use
Districts, Height Districts and Rezoning of
certain properties in the City of Saint Paul,
as amended. This is an emergency ordinance
rendered necessary for the preservation of the
public peace, health and safety.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Zoning Code, Chapters 60 to 64,
inclusive of the Saint Paul Legislative Code, pertaining to
Use Districts, Height Districts and Rezoning of certain pro-
perties in the City of Saint Paul, as amended, be and the same
is hereby further amended so as to rezone the following des-
cribed property from "All Residence District to Commercial
District, to -wit:
"The Easterly 36.78, feet of Westerly 50 feet of
Lot 4, Block 251 Auditor's Subdivision No. 62,
St. Paul Minn. ;"
situate on property located at the southeasterly intersection
of Highways No. 12 and No. 61 in the City of Saint Paul.
Section 2. This ordinance is hereby declared to be
an emergency ordinance rendered necessary for the preservation
of the public peace, health and safety.
Section 3. This ordinance shall take effect and be
in force upon its passage, approval and publication.
V. PETITION TO REZONE
A petition having been filed request-
ing that Chapters 60 to 64 inclusive, St. i
Paul Legislative Code, re Zoning, etc.,
be amended so as to rezone property
described as follows: Easterly 36.76 feet
of Westerly So feet of Lot 4, Block 25,
Auditor's Subdivision #62, at the south - +
east intersection of Highways #12 and
#61, to Commercial District, the Coun-
cil of the City of Saint Paul has fixed
the 25th day of March 1965, at ten
o'clock in the forenoon in the Council
Chamber in the City Hall of said City, i
and at said time and place, the Council
will hear all persons and all objections
and recommendations relative to said
proposed amendment.

This is in reply to the referral of the petition of Chester M. Tobin
to rezone from "A" residence to, commercial _district property located
at the southeasterly intersection of Highways. #12 and #61 described
as the-Ely 36.78 feet of the Wly 50.feet of Lot 4, Block 25, Auditor's
Sub 3�' a. y w�v • _ s 6�� w.ti, �,
On February 19, 1965, the Commissioner of Finance reported the petition
sufficient with the owners of two of a possible two (1000) tracts of
land within the prescribed 100 foot radius having signed the petition.
The Board of Zoning considered this matter at its regular meeting on
March 4, 1965. The staff reported that the ^property immediately ad-
joining on the east had been rezoned to commercial district on
April 11, 1964 at which time the Highway Department indicated that
they intended to acquire the westerly 50 feet of Lot 4 which was ex-
cluded from the rezoning. A final determination has been made and
the Highway Department will not acquire the Ely 36.78 feet of the
Westerly 50 feet, therefore the petitioner is asking to have said
36.78 feet rezoned to a commercial district in order to consolidate
it with the adjoining commercial property for the purpose of construct-
ing a filling station. It does not appear that this rezoning will
have a detrimental effect 'on any of the surrounding properties.
The Board of Zoning recommends the granting of the petition to rezone
the above described property to a commercial district.

Gentlemen:
In March 1964 you rezoned all except the west
fifty feet of Lot 4, Block 25; Aud: Sub - division # 629
Ste” Paul, Minnesota from #A" Residential District to Commer-
cial District upon my petiti=: in order to construct and op-
erate a gasoline filling station: The reason the west fifty
feet-was excluded was because of a Minnesota Highway Depart-
ment easement on this portion of the lot:
Steps are-being taken to have the Highway Depart-
ment reconvey the easterly'36:78' of the w4sterly 50' of this
easement and so I respectfully petition that this portion of
the lot be rezoned from "All Residential to Commercial District':4

The land to the west'and north of the parcel to be
rezoned is owned by the Minnesota Highway Department for the
right of way of Highways U.S. # 61 and 7. Sr. # 12. The land
across the street to the south`is leased to the Standard Oil
Company operating a filling station, while this Lot 4, Block
25 is to used by the Shell Oil Company for a Filling Station.
The land to the east'and south for 100' and also for
