Notwithstanding any provision of the charter of � the city of Saint Paul or statute to the contrary, the city of Saint Paul may by ordinance provide for the levy and collection of a tax on the purchase and use of local exchange telephone service as hereinafter provided. Sec. 2. Subdivision l. In no case shall the combined federal and city exciSe tax exceed ten percent of the lawful rates for such l.ocal telephone services, including equipment rentals but � excluding directary charges, toll and long distance services� and federal excise taxes. Subd. 2. � The tax shall be imposed at a uniform rate on all such telephone service ar�d shall be limited to those � telephones located within the geographical boundaries of the city. The commissioner of f�nance of the city of Saint Paul shall. provide the telephone company a true and correct copy of the ordinance together with a statement setting forth the effective date thereof , a n•d the services which are made subject to the tax. Subd. 3. The telephone company shall include the tax in its bills to i�s subscribers and state the same separately � beginning with the billing period in which the tax first becomes effective. The tax shall be paid to the company for 1 : r" " . . r � . 3-22-65 No. �3 � �he use and benefit of the city, and the companti shall b� liable only for such tax as is actually paid to it by or on behalf of its customerso Subd. 4. No tax shall be imposed under� authority of this act on the state of Minnesota, its political subdivisions or their departments or agencies,, the government of the United States, its departments or agencies� or where prohibited under the Constitution or laws of the United States� or under the Constitution of this state, or on the use of coin-operated telephones . Sec. 3. . Taxes collected by the telephone company attributable to the city shall be due and payable to the commissioner of finance of the city at monthly intervals under � such terms and conditions as specified in the ordinance. Sec. 4..
