WHE�REAS, Presently there is in existence an areaway located
at the southeast corner of University Avenue and Mississippi Street
which was constructed by permission of the Department of Public Works
�5ecured on or about January 27, 1937, by the then owner of Lot 6, Block 2,
Dayton's Addition, subject to the conditions presently set forth in
Chapter 207 of the Saint Paul Legislative Code, as amended, which
conditions were binc�ing upon the owner and the owners' suceessors and
assigns; and
WHEREAS, The Department of Public Works �is in the process of
preparing plans and specifications for the grading and paving of University
� Avenue from Mississippi Street to Lafayette Road which is designated as
City Project No. P-354 and pursuant to such proposed work reauires that
the said areaway be removed; now, therefore, be it
�
RESOLVED, That the Commissioner of Public Works be directed to
order the o�aner of Lot 6, Block 2, Dayton's Addition, the property adjacent
to and connecting with said areaway to remove said areaway at the o�,mers'
otvn expense within thirty (30) days from the date of this order pursuant
to Chapter 207.02 (1) o£ the Saint Paul Legislative Code, as amended.
