An Ordinance amending the Zoning Code,
Chapters 60 to 64, inclusive, of the Saint
Paul Legislative Code, pertaining to Use

rendered necessary for the preservation of

THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Zoning Code, Chapters 60 to 64,
inclusive, of the Saint Paul Legislative Code, pertaining to Use
Districts, Height Districts, And Rezoning of certain properties
in the City of Saint Paul, as amended, be and the same is hereby
further amended so as to rezone the following described property
from "A" Residence District to' "C -1'i Residence District, to -wit:
"Lots 9, 10, 11, 289 29 and 30, Block 12� -
Dawson's Lake Como & Phalen Avenue Addition
to the City of St. Paul, Ramsey Co., Minnesota,
and Lots 12, 13, 14, 15 and 16, except the easterly
seven (7) feet thereof, Lot 23, except the easterly
seven (7) feet thereof, Lots 24 25, 26 and 27,
Block 12, Dawson's Lake Como & Whalen Avenue Addi-
tion to the City of St. Paul, Ramsey Co., Minnesota ;"
situate on property located on-,the south side of Hoyt Avenue
and on the north side of Montana Avenue between Westminister
Street, and Highway No.- 35E.
Section 2. This ordinance is hereby declared to be
an emergency ordinance rendered necessary for the preservation
of the public peace, health and safety.
Section 3. This ordinance shall take effect and be in
force upon its passage, approval and publication.

Dear Sir:.
This is in the matter of the petition of City Homes Inc. to rezone to
Light Industry and "C" residence district property located on the south
side of Hoyt Avenue and the north side of Montana Avenue between West-
minster and Mississippi Streets which is described as Lots 9 thru 15,
Lotl6 ex. the Ely 7' thereof; Lot 23 ex. the Ely 7' hereof, Lots 24 thru
30, Block 12, Dawson's Lake Como & Phalen Avenue Addition.
On November 25, 1964, the Commissioner of Finance reported the petition
sufficient with the owners of 14 of � possible 19 (740) tracts of land
within the prescribed 100 foot radius having signed the petition. On
January 26, 1965, the City Council-, by resolution, granted an extension
of time until April 1, 1965. The site is now vacant and it is proposed
to develop it with a multi- family development.
The Board of Zoning considered this matter at its regular meeting on
February 18, 1965. The staff reported that because of the topography
in this area, the subject property's relationship to the Freeway and
other existing uses, it would appear that it should not be reclassified
to either Light Industry or "C" residence district, but a reclassification
to a "C -1" residence district would establish a desirable transitional
use between the light industry development approximately one and one -half
blocks to t -he south and the single- family development to the north and
east.- The members of the Board discussed the matter with the attorney
for the applicant. In a letter dated March 1, 1965, the petitioners,
City Homes Inc., advised that they are agreeable to the "C -1" classi-
fication.
In consideration of the above factors, the Board of Zoning recommends
the reclassification of the above described property to a "C -1" resi-
dence district.
