Dear Commissioner:
The attached agreement for use of certain types of debris to be deposited at the
Wakefield-Frank Area:is petitioned for filling by forty-two persons in the im-
mediate vicinity of this large, deep ravine.
As you know, during our trials of the last flood, we were graciously given per-
mission to use this area for the disposal of general refuse under an emergency
condition. �
On Monday, April 10, 1965 this area ceased to be available for the disposal of
all general refuse. It, therefore, has been thoroughly covered with clean fill
at each area of disposal.
This bureau would highly recommend the agreement be passed by our City Council
under the stipulated conditions of this contract for the disposal of materials
such as pointed out in this agreement.
We have made a thorough survey of the residents in the nearest proximity to this
ravine and have found that all are in accordance with the filling of this area
with the type of materials planned for disposal.
Although several owners are involved in a portion of this ravine which reaches
Conway Street, F have one letter from an adjacent owner to the present petition-
er who would also like to have his property filled.
I am sure that should this contract be in agreement with the City Council that
all other owners of this ravine would be very happy to let us continue filling
this area.
I believe that due to the action and comment of the Smoke Abatement Committee
�asking this department to cease burning at Pig's Eye that this would be ideal
for disposal of materials that were formerly sent to the burning area at Pig's
Eye.
Also attached are notes from residents in the �mmediate area who strongly re-
commend the filling of this area. I believe that the Bureau of Health in the
City of Saint Paul would also strongly recommend our position in this matter.

There have been quite a few complaints in the past years to the Bureau of Health
regarding the very dangerous conditions existing in this ravine for children who
seem to use it as a playground.
This area is approximately one-hundred feet deep and about eight-hundred feet wide
and approxiinately one and one half blocks long.
This bureau, therefore, strongly urges the passage of this agreement by the City
Council so that we may divert the materials such as demolition, wood and trees
to this point as soon as possible remembering that considerable demolition will
have started in the loop in a very short time.

W I T N E S S E T H:

OtlE AND N0�100 �OLLARS ($1 .00) to it paid by the City, the receipt thereof
is �ereby acknowledged, and in further consideration of the faithful performances
• by the City of all the agreements herein c�ntained, hereby c��rants unto said
City .the ric�ht, license and privilege of using f or an all purposc dump on the
property described as followt Lot 7 to 11 inclusive, also lots 12 to 19 inclusive
all in Rlock 6, H. F. Schwabe's Addition, and the north one-half of vacated
� Wakefield Avenue adjoining and adjacent thereto; subject to the follawing
conditions and reservationsa
1 - That the party of the first part shall provide pubiic liability
insurance covera�e indemnifying said City, its officers, agents, servants, and
employees against any such liability in an amount of $100,000 on account of � ,
personal injury from any one accident and $5000 on account of injury to property
on account of any one accident, '
2 - That a substantiai and secure fence be erected on the outside boundary
of aaid property by the party of the first part, the height and type of fence to
be determined and approved by the Department of Public Works.
