06-180Council File # V� � � V� Resolution # Green Sheet # �� a ��R� RESOLUTION OF SAINT PAUL, MINNESOTA 2 3 4 5 6 7 9 10 11 12 13 14 15 16 17 18 19 ZO 21 L2 23 )_q z5 26 7'7 28 29 30 31 32 33 34 35 36 37 38 39 �0 �1 Presented Referred To Date WHEREAS, the City Council adopted resolution number 02-1070 that accepted a$200,000 grant from the family housing fund and established guidelines to be used in the expenditure of those funds on the tenant remedy actions initiative under State Law; and WHEREAS, Resolution Number 02-1070 only authorized City initiated tenant remedies actions; and 13 WHEREAS, the Tenant Remedies Action Program has provided necessary and critical improvements for numerous rental properties in the City of Saint Paul that have prevented building condemnations and maintained safe and affordable housing for low income tenants; and WHEREAS, the City Council desires to provide specific authorization for Southern Minnesota Regional Legal Services (SMRLS) to continue to work with the City on tenant remedy actions; and WHEREAS, the City Council wants to specifically authorize and identify the procedures that must be followed in order to develop the appropriate contract with SMRIS to continue the Tenant Remedies Action Program for both City initiated and SMRLS initiated tenant remedies actions; NOW THEREFORE BE TT RESOLVED, that the City Council establishes the following guidelines to be used in developing a contract with SMRLS for the use of these funds: 1.) Identify a pool of qualified administrators through the City's Contract and Analysis 5ervices Division; or, identify City employees from the Department of Planning and Economic Development to act as court appointed administrators; 2.) That a master contract will be developed with SMRLS subject to approval by the City Attorney; 3.) That all improvements that are done will be in compliance with the City's permit process by duly licensed contractors. The TRA Fund shall not be used to reimburse the City for staff time associated with code enforcement activities or staff Ume and court costs associated with city initiated or SMRLS initiated tenant remedies actions; 4.) That a scope of work and a budget shall be developed for each property and approved by both the City Attorney and the Director of NIIPI; 5.) A scope of work plan and budget shall be developed for each property for which the City pursues a tenant remedy action where the TRA Fund may be accessed, and this plan shall include: r , ;► �2 �3 � �5 �6 �7 �8 39 50 51 52 53 54 55 56 57 58 59 50 51 52 53 54 55 56 57 58 59 70 71 72 73 74 75 76 77 78 79 30 81 B2 B3 B4 BS 36 B7 88 39 a) A"Dwelling Economic Viability Statement" shall be developed, in consultation with the Department of Planning and Economic Development, for all properties for which the City files tenant remedy acrions, pursuant to Minnesota Statutes, Chapter 504B.445, Subd. 8, which states: In considering whether to grant administrative funds under subdivision 4, the court must consider factors relating to the long-term economic viability of the dwelling, including: (1) (Z) (3) (4) the causes leading to the appointment of an administrator; the repairs necessary to bring the property into code compliance; the mazket value of the property; and Whether present and future rents will be sufficient to cover the cost of repairs or rehabilitation. b) In TRA cases where the TRA fund will be used, the order of the court shall specify a specific plan for repayment of the TRA Fund including pernut requirements, and the preparation of invoices to the finance department for payment; and c) A limit of $3,000 in estimated unrecoverable expenses, e.g. those expenses the city cannot recapture through the use of assessments, judgments, liens, rents or refinancing of the property, is allowable per property when using the TRA fund, without a waiver by the Council; and be it FCTRTHER RESOLVED, that the Saint Paul City Council hereby requests the Director of NHPI to develop the appropriate contract with SMRI.S to continue the Tenant Remedies Action program; and be it FINALLY RESOLVED, that the City Council hereby requests Director of NIIPI to provide the City Council with a quarterly report that summarizes each Tenant Remedies Action pursued by the City and by SMRLS and that the report contain information on number of units affected, expenses for management and improvements, and an estimate of any un- recoverable expenses.
