UNCIL RESOLUTION-GENERAL FORM

COMMISSIONE n DATE
RESOLVED, That the State of Minnesota, in consider�tion of the
mutual covenants and agreements hereinafter contained be granted
a temporary construction permit for a period of time �erminating
on or before December 1, 1967 for the construction of a temporary
by-pass as a part of the general plan of improvement and protection
of T.H. 35E=390 on the following described real estate in the
County of Ramsey, in the State o f Minnesota:
That portion of the block bounded on the north
by Eleventh Street, on the south by Tenth Street, on
the east by Cedar Street and on the west by Wabasha
Street as �hown in red on the map attached hereto and
made a part thereof; and be it
FURTHER RESOLVED, That the State of Minnesota upon termination
of uae of this area for by-pass purposes agreea to regrade, topsoil
and sod the area disturbsd by its construction �f�o its existing eon-
dition; and be it
FURTHER RESOLVED, That the Minnesota Highway Department will ,
accomplish this restoration at the same time as the disturbed
r � Yabutting City dedicated street, curb, walk and -driveway areas are
restored to their existing or newly designed condition; and be it

curbing located on or ad,jacen� to the above described tract; and

be accompliahed to the satisfaction of the Comm�ssioner of Public

FURTHER RESOLVED, That the State of Minneso�a or its Contraetor
shall procure and maintain a� all times, and at said parties own
cost and expense, public liability casualty insurance coverage
indemnifying said City of Saint Paul, against liability on account
of personal in�uries to the extent of $250,000 for in�ury to one
person and $500,000 for peraonal in�uries caused by one accident,
and on accoun� of property damages to the extent of $100,000 on
account of any sin�•le claim and $150,000 on aecount of any single
accident, and to file evidence of said coverage with the Comptroller
of the Ci�y of the City of Saint Paul in form approved by the
Corporation Counsel; and be it
FURTHER RESOLVED, The State of Minnesota accept the terms and
conditions herein in the form of a letter signed by a duly
authorized officer of the S�a� which shall be f3.1ed with the Clerk
. of the City of St . Paul within�(10) days of passage of this
resolution.
