' Resolved, That ypdn the petition of
Superior Packing Company, that sec-
tion of public street hereinafter de-
scribed be and the same hereby is
vacated and discontinued as,a public
street:
� "That portion of the northeasterly
7 feet o4 Wabash Avenue lying be-
tween the present easterly line of
Montgomery Street and the east-
erly line of Lot 119, Hewitts Out
Lots First Division,extended south-
erly;" .
sub�ect expressly to the following con-
ditions and reservaUons:
1.that the vacation be subiect to all
the terms and condiUons of Section
228 of the I,egislative Code regulat-
dng the procedure and prescribing
conditions for the vacatlon of.pub-
lls grounds, streets, alleys and high-
ways irL the City of Saint Paul;
2.that the vacation be described as
follows: that portion of the norfih-
easterly 7 feet of Wabash Avenue
Iying betiveen the present easterly
line of Montgomery Street and the
easterly line of Lot 119, Hewitts Out
Lots First Division, extended south-
erly; •
3.that the vacation continue for a
period of 4orty years, or the life of
that portion of building whiph is
located on the portion of the street
vacated, whichever is the lesser;
this condition to run with the land
and be binding upon the owner, or
owners, and their successors in in-
terest;
4.that th�owner of said building shall �
be entiUed to make necessary re-
pa3rs Por the purpose of maintain-
1ng those portions of the building
]ocated upon the portion oi street
being vacated in good and useable
condition and shall be entitled to
erect and maintain an enclosure,
rails, or other necessary packing
house facilities over that portion o�
the street being vacated which pre-
sently constitutes an open loading
• dock covering approximately the
northwesterly 302.1 feet of said sec-
tion of street•
5.that the peti{ioner pay to the City
the sum ot $980.00 aq compensation
for the vacaUon and provide the
City with a bond in the amount of
. 51.000.00. -
