THIS,IS AN EMERGENCY ORDINANCE RENDERED NECESSARY FOR THE PRESERVATION OF THE PUBLIC PEACE, HEALTH AND SAFETY. THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: i r k. i r a 1 I i Section 1. That Ordinance No. 12916,,approved February 24, 1965, be and the same hereby is amended by striking subparagraph (a) from Section 1 thereof and substituting in-lieu thereof the following subparagraph (a): "(a) the dedication to the City of Saint Paul, for street purposes, of the easterly 33 feet of Lot 21 and the west 38 feet of the east 71 feet of the south 105 feet of Lot 21, Cottage Homes." Section 2. That the conditions of this amendatory ordinance must be approved and accepted by the petitioner within 30 days of its first publication. Section 3. This ordinance is hereby declared to be an emergency ordinance rendered necessary for the preservation of the public peace, health and safety. Section 4. This ordinance shall take effect and be in force upon its passage, approval and publication. The ordinance contained a condition re- quiring the vacation of Western Avenue and the dedication of certain grounds for street purposes, which would be an extension of Farrington Avenue from Cottage south to the Northern Pacific right -of -way. The Public Works Department subsequently requested that Western Avenue not be vacated and we thereupon withdrew our application to vacate Western Avenue, and Your Honorable Body, by Council File #223012, amended the ordinance rezoning this property, so as to eliminate the requirement for the vacation of Western Avenue.
