THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Zoning Code, Chapters 60 to 64,
inclusive, of the Saint Paul Legislative Code, pertaining to
Use Districts, Height Districts, and Rezoning of certain
properties in the City of Saint Paul, as amended, be and the
same is hereby further amended so as to rezone the following
described property from "B" Residence District to Light
�. Industry District, to -wilt:
"Lots 19, 20, 219 229 23 and Lots 1, 29 39 49
Block 3, Major's Addition, Ramsey Co., Minn. ;"
situate on property located on the west side of Leland Street
between Benson Avenue and AgnesX Street in the City of Saint
Paul.
Section 2. This Ordinance is hereby declared to be
an emergency ordinance rendered necessary for the preservation
of the public peace, health and safety.
Section 3. This Ordinance shall take effect and be
in force upon its passage, approval and publication.

Dear Commissioner:
I am enclosing a copy of a Petition that was filed with
the City Lighting Engineer, Howard Lowe. This Petition
contains the names of over ninety per cent of the property
owners in a four -block area on Grand, between Hamline and
Snelling, and adjacent property owners on Lincoln and
Summit, who are opposed to ornamental lighting as previously
considered by the Council. , .
The property owners who have signed the Petition urge the
same type lighting as proposed on Grand Avenue west of
Snelling. This block has five lights, which the petitioners
propose for their area. A picture is enclosed of the one -
block area on Grand Avenue between Snelling and Macalester.
Traffic volume counts and a summary of,these counts are en-
closed, which show that vehicular traffic is heavier west of
Sneliing on Grand than east of Snelling to Hamline on Grand.
The proposed six ornamental lights per 600 foot block will
cost $3,150 per block, whereas, if the area between Hamline
and Snelling on Grand is treated the same as the area between
Snelling and Cretin on Grand, there will be five lights in
a 600 foot block at no cost to the adjoining property owners.
The property owners between Hamline and Snelling on Grand feel
their area is predominately residential and should be treated
the same as the area between Snelling and Cretin on Grand
regarding the proposed lighting on Grand Avenue.

ADVISABILITY AND DESIRABILITY
IMPROVE GRAND AVENUE by resurfacing the roadbed from Cretin Avenue to Oakland Avenue
and by constructing an ornamental lighting system from Snelling Avenue to Oakland
Avenue. (See Location Map)
This improvement was originally before the Council based on a recommendation
of the Grand Avenue Business Men's Association and by the Commissioner of Public
Works as a public necessity. The old pavement surfaces of various types are un-
sightly and in a poor, rough condition requiring unusually high ,maintenance expenses.
The existing lighting system is obsolete and inadequate.
This improvement is now before the Council based on a motion by the Council to
reconsider Final Order 2229090 approved April 13, 1965 and a directive by the Council
that a bearing be held to clarify the nature of the improvement by defining repaving
as resurfacing-over the existing roadbed.
The roadway proposal to to resurface over the existing brick pavement and track
area with two layers (3''! - 411) of asphaltic concrete except that at bus stops the
existing surfacing will be replaced with concrete to avoid shoving by heavy buses.
Deteriorated and sunken curbing will be replaced and the concrete base will be re-
placed at locations showing failure.
A new ornamental lighting system is proposed by the Lighting Bureau to be
constructed from Oakland Avenue to Hamline Avenue by installing underground conduit
and wiring with 400 watt mercury vapor units mounted on steel standards at a uniform
spacing of 120 feet. This to to meet and slightly exceed the minimum quality and
quantity of illumination as recommended by the Illuminating Engineer °s Society for
the present volumes of vehicular and pedestrian traffic. The lighting would be
similar to that installed on other arterials and business streets, such as Rice
Street, Pascal Street and Oakland Avenue. The Importance of adequate lighting in
safety, crime prevention and aesthetics is will established and this Improvement
has been requested by petition.
The total estimated cost is $429,326.08, of which $3509682.08 is for resur-
facing, $77,000.00 is for ornamental lighting and $1,644.00 to for miscellaneous
costs. Financing this project is planned as follows:
$39,813.00 from the Twin City Rapid Transit Suspense Fund; $1999483.08 from
Municipal State Aid (1965) and $190,030.00 from estimated property assessments.
The estimated assessment rates (per assessable foot) are as follows:
Resurfacing Curbing Lighting
Residential $3.50 $1.00 $5.25
Commercial and °C9 Residential 4.10 2.00 5.25
Driveways, newer and water connections and other items of exclusive benefit
to abutting property would be assessed in addition to the above rates.
The Department of Public Workse recommendation is for acceptance of the
roadway portion of Final Order 222909, approved April 13, 19659 in which "repaving"
is ,meant as resurfacing over the existing roadbed as outlined above. On the recom-
mendation of the Lighting Bureau the order should be amended to provide for now
ornamental lighting from Oakland Avenue to Hemline Avenue only, thus eliminating
the lighting portion from Hamline Avenue to Snelling Avenue.

Dear Sir:
I would like to voice my objections fo the Ornamental Lighte
ing project that has been proposed for Grand Avenue. We live at
2139 Grand Avenue. It is not possible for us as property owners
to use the street in front of our home for parking cars. There are
many apartment buildings in our area. Some of them have provided
parking area for their tbmants, while others have not. St. Thomas
College is one block away from us. The school is in session nine
months of the year and four to eight weeks in the summer. The Wm.
Mitchell Law School is open tine months of the year and six weeks of
the summer. The students from these schools use the space in front
of our homes to park their cars, both during the daytime hours and
from 6 :00 to 10:00 p.m. daily. When it is necessary to have a Doc-
tor come to our homes he must use the alley entrance. Because of
these bad parking situations I don't think it is at all proper for
the property owners to be asked to pay for Ornamental Lights that
will be of no use to us. Our block consists of twenty -eight forty
foot lots. The bill for this at the price quoted on my letter from
you would be $6,080.00. I believe this is much to expensive.
Many of the residents on Grand Avenue have been paying taxes
for many years. They are now our Senior Citizens, living on a very
limited pension or Social Security and cannot afford this_Luxury.
I assume the businessmen on Grand Ave. want to have the lights.
I think this may be fine for that portion of Grand Ave. that has a
concentration of business. I'm sure this assessment may be consider-
ed operating expense for them, which is not true for residential
property owners.
It would appear to me that the charge for water connections
is quite high when it is being done in volumne. I'm quite sure it
could be done only when it becomes a necessity for this price. To
replace curbing where present curbing is sound is very unreasonable.
We are not against progress; the street needs resurfacing,
but some of the added items are uncalled for on our end of Grand
Ave. Most of our neighbors feel as we do. We feel the Councilmen
should take into condideration the home owners plight.

There will be a public hearing in the Council Chambers at 10 o'clock
April 13th regarding'repaving Grand Ave.
I agree that Grand Ave. needs repaving and the cost for the paving
seems to be fair enough.
It seems to me that the cost for LIGHTING is T00 HIGH, and surely
will work a financial hardship on many home owners including myself.
I hope that you can work out something less is cost for the lighting
on this street..

Please be advised that the Grand Avenue Business Association,
which has previously petitioned the City Council for the improvement of
Grand Avenue from Oakland to Cretin, together with the installation of
ornamental lighting, now wishes to revise its petition so as to eliminate
ornamental lighting west of Snelling Avenue.
The question of re- covering the street as against reconstruction
has also been discussed by the Association, and it is their opinion that
the best development for the City and the most economical in the long run
is reconstruction, as it is felt that merely re- surfacing the street
would result in further problems at an early date.

Dear Commissioner Dalglish;
As a personal property tax payer living on Grand Ave, I wish to
register a complaint against the proposed Grand Avenue improvement
project. The street repair and repaving I go along with, it is
something we need, the buses and trucks have taken there toll over
the period-QL-years._ But the ornamental lights as proposed to be
installed we can do without and I am strongly opposed to it, at
$5.25 per foot yet and we have a 50 ft.frontage. If the business
men think they need more light in front of their places of business,
let them install additional lights and pay for it themselves, not
the taxpayers all along Grand Ave. as proposed. The Grand Avenue
property tax payers are being discriminated against to satisfy a
few, and I hope the Commissioners will agree to eliminate the
ornamental lighting proposal in this project.

This is in the matter of the petition of Chrstine McCarthy and =
John P. Pfaff to rezone from "B" residence district to light
industry district property located on the west side of Leland
Street between Benson Avenue and Agnes Street which is described
as Lots 19, 20, 21, 22, 23 and Lots 1, 2, 3, 4, Block 3, Major's

On March 5, 1965, the Commissioner of Finance reported the petition
sufficient with the owners of 20 of a possible 28 (71.4270) tracts
of land within the prescribed 100 foot radius having signed the '
petition.
The Board of Zoning considered this matter at its regular meeting
on March 18, 1965. The staff reported that the petition states
that the subject property would be developed with an industrial
building to be used for the manufacture of display fixtures, employee
parking and for future expansion of said business. The Comprehensive
Land Use Plan indicates that the properties in this -area should
ultimately be developed for industrial purposes. The surrounding
area has developed substantially in this direction within the past
five years.
In consideration of these factors, the Board of Zoning recommends
the granting of the petition to rezone the above described property,
to a light industry district.
