Re: Vacation of Fourth Street east of
Broadway
Gentlemen:
The Public Works Department has re- examined the matter of the above vaca-
tion since the receipt of the letter to the City Council dated December 8, 1965,
from Mr. Carl A. Swenson, Attorney for Sta -Vis Oil Company. In his letter Mr.
Swenson made requests for four specific actions by the City which he felt would
be necessary to provide the Sta -Vis Oil Company with suitable access if the
vacation was approved.

His first request was for the prohibition of parking on both sides of
Fourth, Fifth and John Streets during daytime hours because of the heavy traffic
flow which might result from the Toni Company's operation. As the Department
of Public Works stated in its previous report, dated November 30, 1965, we feel
it will be necessary initially to limit parking near the intersections in order
to assist in the turning movements. We also recommend at this time the prohi-
bition of parking on the west side of John Street from Fourth Street to Fifth
Street. This will' assist the traffic movement on this grade between two turns.
The signing controlling parking on Fourth Street east of John Street is to be
improved. Further parking restrictions should not be made unless they are
indicated by congestion as traffic develops. When this becomes apparent, the
Department of Public Works would be in a position to implement restrictions as
necessary.
Mr. Swenson requested that Fourth, Fifth and John Streets should be widened
and sufficient curvature installed to accommodate the largest possible trucks,
which may in the future be up to 60 feet if allowed by State law. The present
street width of Fourth, Fifth and John Streets is 40 feet, which is adequate to
handle trucks of present legal width. There is very little likelihood that ad-
ditional width will be allowed by State law even though it is possible that ad-
ditional lengths could be approved. The City, in its previous report', stated
that it would increase the curvature at the critical corners. After further
study, it is felt that the City should acquire additional property and recon-
struct the radii at the southwest corner of Fifth and John; the southeast corner
of Fifth and John; and the northeast corner of Fourth and John to provide optimum
turning radii for present legal truck sizes. A Preliminary Order for the neces-
sary acquisition has been formulated and submitted to the Council. Plan are
being formulated to accomplish the construction as early as possible in the
1966 construction season.

Mr. Swenson also requested that easements be given to Sta -Vis Oil Company
to erect permanent signs at the intersections of Fifth and Broadway; Fifth and
John and Fourth and John directing traffic to Sta -Vis Oil plant. This practice
is presently prohibited by City ordinance. If it ever became prevalent, it
could lead to all sorts of obstructions, visibility and sight distance problems
throughout the entire City. In order to alleviate any confusion that might
exist about the route to the Sta -Vis Oil Company plant, the City could place
signs at Broadway and Fifth Street West, at Broadway and Fifth Street East,
and at Fifth and John showing the direction to Fourth Street.
Mr. Swenson's fourth request concerns the possibility of allowing both
left and right hand turns from Fifth Street going west to Broadway. It is the
opinion of the Engineering Bureau that a left -hand turn from Fifth Street west-
bound cannot be permitted without creating a serious hazard at Fifth and Broad-
way as long as the present one -way traffic pattern exist on Broadway, Fifth
and Sixth Streets. This is also consistent with the recommendation that was
made in our previous report.
In order to further assure adequate access and because of the hill, we
recommend the placement of John Street from Fourth Street to Fith Street on
the Public Works Department primary list for snow clearing and salting.
It is our opinion that the changes described in this letter, along with
those already agreed upon by the City in previous meetings, would reduce the
inconvenience to the Sta -Vis Oil Company to a minimum.
We would suggest, if the Council concurs in these recommendations, that
a copy be mailed to Mr. Swenson in order that he be fully informed.
