- Resolved, That upon the petition of
The Gillette Company, the section of
public street hereinafter described, be
and the same is vacated and discon-
tinued as a public street, viz.:
Pine Street from the southerly side
of East Fifth Street to the north-
erly side of East Fourth Street; 1
East Fourth Street from the east-
erly side of Broadway to the west-
erly side of John Street; the alley
in Block 45, Kittson's Addition,
being the east -west alley in the )
block bounded by Broadway, Fifth, i
Pine, and Fourth Streets;
subject expressly to the following con-
ditions and reservations:
1. that the vacation be subject to all
the terms and conditions of Section
228 of the Legislative Code, as
amended, regulating the procedure
and prescribing conditions for the
vacation of public grounds, streets,
alleys and highways in the City of
Saint Paul;
2. that easements to protect the ex-
isting utilities be specifically re-
tained;
3. that upon the submission of evi-
dence that satisfactory arrange-
ments have been made for the re-
location of the existing utilities, the
easements retained under Condi-
tions 1 and 2 may be waived by
subsequent resolution;
4. that no change in the surfacing or
grading of the existing streets shall
be made until Condition 3 above is
fulfilled;
5. that street closures satisfactory to
the Department of Public Works be
installed and co- ordinated with the
reopening of the intersection of
Fifth and John Streets and con-
current with the filing of the vaca-
tion plan in the Office, of the Reg-
ister of Deeds;
6. that the petitioners pay to the City
the sum of $43,475 as compensation
for the vacation;
7. that the petitioners agree to pay for
the cost of increasing the radius of
curvature at the northeast corner of
John and Fourth Streets and at the
southwest and southeast corners of
John and Fifth Streets, said work to
be performed by the Department of
Public Works, the cost of which has
been estimated at $2,500.
8. that the petitioners convey to the
City for public thoroughfare pur-
poses the following described prop -'
erty:
that triangular portion of Lot one
(1). Block forty -seven (47), Kitt -
son's Addition to Saint Paul, de,
scribed as follows: beginning at
the most northerly corner of said
Lot one (1); thence southeasterly
along the northeasterly line of
said Lot one (1), a distance of
fifteen (15) feet; thence westerly
to a point on the northwesterly
line of said Lot one (1), which is
fifteen (15) feet southwesterly of
the point of beginning; thence
northeasterly along the north-
westerly line of said Lot one, (1),
a distance of fifteen (15) feet to
t' the point of, beginning;
9. the bond provided for in said
Chapter 228 to be filed by said peti-
tioners, is hereby fixed at the sum
of $50,000.
