In the Matter of condemning and taking an easement in the land necessary for the
slopes cuts, and fills, including right of removal of lateral support from subject
land or remainder thereof occasioned by excavations thereof or construction of slopes
in the grading and surfacing with bituminous material the alley in Smith's Subdivision
of Block 2, Stinson's Division of Lots 31 to 60 inclusive from Mackubin to Arundel Sts.
-under Preliminary Order 225686 approved October 22, 1965
The Council of the City of St. Paul having received the report of the Commissioner of Finance
upon the above improvement, and having considered said report, hereby resolves:
1. That the said report and the same is hereby approved and adopted, and the said improvement
is hereby ordered to be proceeded with.
2.., That the nature of the improvement which the Council recommends is
to condemn and take an easement in the land necessary for the slopes, cuts and fills,
including right of removal of lateral support from subject land or remainder thereof
M occasioned by excavations thereof or construction of slopes in the grading and sur-
facing with bituminous material the alley in Smith's Subdivision-of Block 2, Stinson's
Division of Lots 31 to 60 inclusive from Mackubin to Arundel Streets, in accordance
with the blueprint hereto attached and made a part hereof, the hatched portions showing
the cuts and the shaded portions showing the fills,
with no alternatives, and that the estimated cost thereof is $ 75.00
Resolved Further, That a public hearing be had on said improvement on the 25th day of
January, 1966 , at the hour of 10 o'clock A. M., in the Council Chamber of the Court
House and City Hall Building in the City of St. Paul. That the Commissioner of Finance give notice of
said meeting to the persons and in the manner provided by the Charter, stating the time and place of
hearing, the nature of the improvement and the total cost thereof as estimated.
