2 WHEREAS, adverse action was taken against all licenses held by American Legion, d/b/a Arcade
3 Phalen Post #577 (License ID#006143'7) for the premises located at 1129 Arcade Street in Saint Paul, by
4 Notice of Violation dated October 26, 2006, alleging licensee aliowed a non-member or bona fide guest to
5 enter his private club on October 13, 2006, without signing in and purchase an alcoholic beverage which is
6 in violation of Minn. Stat. 340A.404, subd. 1(4) and Saint Paul Legislative Code §409.02; and
WHEREAS, The Office of License, Inspections and Environmental Protection kias recommended a
9 $500.00 fine; and

11 WHEREAS, the licensee has not contested the allegations; now, therefore be it

13 �SOLVED that American Legion, d/b/a Arcade Phalen Post #577 is hereby order to pay a fine of
14 $500.00 for allowing a non-member or bona fide guest to enter your private club without signing in and
15 order an alcoholic beverage on October 13, 2006.

Dear Sir/Madam:
The Office of License, Inspections and Environmental Protection has recommended
adverse action against all the licenses held by American Legion, d/b/a Arcade Phalen Post #577
for the premises located at 1129 Arcade Street in Saint Paul. The basis for the adverse acfion is
as follows:
On October 13, 2006, a Saint Pani police officer came to the American
Legion Arcade Phalen Post #577 by request of the Office of License,
Inspections and Environmental Protection (CN #05212061). He noted in his
reporE that the establishment is a private club and therefore should not be
open to the pnblic. The officer is not a member of the Legion and was not
accompanied by a member.
He was able to walk into your establishment because the door was unlocked
and noticed there was no guest book to sign at the door. He went directly to
the bar and ordered a Bud Light. The man behind the bar said he did not
have a Bud Light so the officer ordered a beer from the tap. He later asked
the female bartender for a Bud Light and she brought him a can. Neither
bartender requested identification from the officer in order to determine
whether he was a member of the club.

While he was there, Ehe officer observed an unknown man come into the club
and saw hewas also served a beer. It did not appear the nnl�nown man l�ew
anyone in the club.
Allowing non-members to enter your establishment and serving them alcohoi
violates your status as a private club according to 1Vlinu. Stat. 340A.404,
subd. l(4} which defines a private club as an °Carganizafion that has been in
eaistence for at least three years and liquor sales will only be to members or
bona fide guests." and Saint Paul Legislative Code §409.02 which states
".....A club shall a]so, in order to be licensed, meet the provision of Miunesota
Statutes, Section 340A.404, subdivision 1(4), which requires that the
organization shall have been in eaistence for at least three (3) years, and
liquor sales will be only to members and bona fide guests"
In addition you requested a change in license category due to a decrease in
membership. The Office of LIEP requested a membership list to verify the
number of ine�bers, but as of today's �ate it has �o*_ baQn sypplie3 to the�.
As a result of this violation, the licensing office will recommend a$500 fine and request that you
supply them with a list of your members. They also request that your organizafion remain in
compliance with state and city pxivate club requirements at a11 times. To prove tbis compliance,
the licensing office wishes to add the following condition on your license:
1.) The anly persons admitted into the Zicensed premises shall be members and their bona fide
guests. Guests must register by signing the guest book when entering. The guest book must be
placed at the front door. The required format for the guest book shall be first name, last name
both signed and printed. Must indicate what member they are with. All must be zn date ordeY
and readable. Guest records must be kept for six(6) months and will be made available to the
inspector or police officers upon request.
At tliis time you have three options on how to proceed:
You can pay the recommended $500.00 fine, provide a list of your members and sign and
return the enclosed license condition form. Tf this is your choice, please send the
payment and requested information directly to the Office of License, Inspecfions and
Environmental Protection, at 8 Fourth Street East, Suite 200, St Paul, Minnesota 55101-
1002 no later than Monday, November 6, 2006. Information should be directed to the
attention of Christine Rozek. A self-addressed envelope is enclosed for your
convenience. Payment of the fine will be considered to be a waiver of the hearing to
which you are entitied.
2. If you wish to have a public hearing before the Saint Paul City Councii, you will need to
send me a letter with a statement admitting the facts and requesting a public hearing. We
will need to receive your letteY by Monday, November 6, 2006. The matter will then be
scheduled before the City Council for a public hearing to determine whether to impose
the fine. You will have an opportunity to appear before the Councii and make a
statement on your own behalf.

3. ff you dispute the above facts, you can request a hearing before an Administrafive Law
Judge. At that hearing both you and the Cify wiil be able to appear and present
witnesses, evidence and cross-exanune the other's wiffiesses. The 5t. Paul City Council
will ultimately decide the case. If this is your choice, please advise me by Monday,
November 6, 2006, and I will take the necessary steps to schedule the a.diuinistrative
hearing.
If I have not heard from you by fhat date, I will assume that you do not contest the

I, Sgt. Dave Schoen, am assigned to the Vice unit, and work out of the Licensing office, for the city. f was
asked to investigate the American Legion Arcade Phalen Post #577 at 1129 Arcade.
This is a private club, via their liquor license designation, and therefore should not be open to the general public.
On 10-12-06 at approx. 1625 hrs. I entered the establishment. The front door was unlocked, there was a sign
advertising a Spaghetti dinner for $5.00 from 4:30 - 6:30 on the sidewalk directiy outside the front door. Also on
sign on the front ofi the building advertising Texas Hold'em on Tuesday nights.
I walked directiy to the bar, there was not a guest book to sign that I could see. I sat down with four older
patrons at the bar, and there was no one behind the bar at this time. After a few minutes a W/M 60's, 5-9, 200
fbs., bafding wl silverlgray hair; asked me what I wanted. i asked for a Bud Light, he checked a cooler and said
he has Mifler Lite, I said t would take one of the tap beers and pointed to the beer tap. He poured me a beer and

my beer. The bar tender: W/F, 50's, 5-5, 160 ibs., shoulder length silver/blonde hair; brought my change and
sat it in front of ine.
1 drank the mug of beer, and asked the bar tender if she had Bud Light, she retrieved a can of Bud Light, and
took money from my change to pay for it. I made the comment that is what I had original{y asked for, but the
gentlemen couid not find it. She said "ya and he's the boss, good thing I'm around",
we both laughed. I drank part of the beer and left about 1650 hours.
While I was there an unknown man came into the bar and was served a beer, it did not appear that he knew
anyone in the place, as he was treated as a stranger just like I was.

340A.404 Intoxicating liquor; on-sale licenses.
Subdivision 1. Cities. (a) A city may issue an
on-sale intoxicating liquor license to the £ollowing
establishments located within its jurisdiction:
(1) hotels;
(2) restaurants;
(3) bowling centers;
(4) clubs or congressionally chartered veterans
organizations with the approval of the commissioner, provided
that the oxqanization has been in existence for at least three
years and liquor sales will only be to members and bona fide
guests;
l5) sports facilities located on land owned by the
Metropolitan Sports Commission; and
(6J exclusive liquor stores.
(b) A city may issue an on-sale intoxicating liquor
license, an on-sale wine license, or an on-sale malt liquor
license to a theater within the city, notwithstanding any law,
local ordinance, or charter provision. A license issued under
this paragraph authorizes sales on all days of the week to
persons attending events at the theater.

Sec. 409.02. Defnitions.
As used in this chapter, the foliowi�g terms shall have the meanings ascribed to them in this section:
Catering permit shall mean that permit provided for in Minnesota StaCutes, Section 340A.404, subdivision 12.
C/ub shali mean a corporation organized under the laws of the state for civic, fraternai, social or business
purposes or for intetlectuaf improvement or promotion of sports which has more than fifty (50) members and
for more than a year owned, hired or leased a building or space in a buiiding of such extent and character as
may be suitabfe and adequate for the reasonable and comfortabie accommodation of its members, and
whose affairs and management are conducted by a board of directors, executive committee or other similar
body chosen by the mem6ers at a meeting held for that purpose, none of whose members, officers, agents or
employees are paid, directly or indirectly, any compensation by way of profit from the distribution or sale of
beverages to the members of the club or to its guests beyond the amount of such reasonable salary or wage
as may be fixed and voted each year by the directors or other governing body. A club shali also, in order to
be licensed, meet the provisions of Minnesota Statutes, Section 340A.404, subdivision 1(4), which requires
that the organization shall have been in existence for at IeasC three (3) years, and Iiquor sales will be only to
members and bona fide guests. The above term will include private clubs licensed under former Chapter 404
of this Code, so long as they meet the a6ove requirements upon appfication for an on-sale license.

Legion Post 577 to appeaz before the City Council to contest the intended fine of Pive
Hundred dollazs ($500.00).

to further request that a copy of the Complaint as filed by the Qfficer mentioned within it,
be provided to the American I.egion Post 577.
Enclosed is a copy of the Year 2006 Membership Stateinent received from the Deparfinent
of Minnesota, which reflects the nuxnber of inembers belonging to the American Legion
Post 577.
