PAUL FOENCIL NO- y� y ' OFFICE OF THE CITY CLERK COUNCIL RESOLUTION — GENERAL FORM WHEREAS, the Saint Paul Public School System, prior to November 3, 1964, constituted a department of City government under the direction of the Board of Education and, also, subject to control by the Council of the City of Saint Paul; and WHEREAS, the voters of the City of Saint Paul at a duly called election on the 3rd day of November 1964, did, by a lawful majority, elect to convert the Saint Paul Lblic School System from a Special District to an Independent School District; and WHEREAS, pursuant to said vote of the people and pursuant to Chapter 705, Laws of 1965, the School District has now been converted and exists as Independent School District No. 625; and WHEREAS, the provisions of said Chapter 705, Laws of 1965, compel Independent School District No. 625 to contract with the City of Saint Paul for such facilities as are furnished by the Civil Service Bureau, Purchasing Department, Comptroller's Office, Corporation Counsel's Office, election services, and other services formerly furnished to the District by City departments prior to its conversion; and WHEREAS, it is the intent of said Chapter 705 of the Laws of 1965 that Independent School District No. 625 pay the propor- tionate cost for operation of the various services to be contracted for; and WHEREAS, the various departments of the City of Saint Paul have now prepared estimates of the pro rata share of the costs to be paid by said Independent School District No. 625 for services during the calendar year 1966; now, therefore, be it F ®R PF70VED -7� cc, a st. That this contract and the terms and provisions hereof will be in effect from January 1, 1966 to December 311 1966, and that the terms and provisions hereof will bind said parties , during the term of this agreement and# further, that .the execution of this agreement shall in no way affect the right of 1 either party to renegotiate any or all portions of this contract for subsequent periods after 1966. 2. That the purpose of this contract by and between the parties is to comply with those provisions as enumerated in Chapter 705, Laws of 1965, as they relate to the furnishing of City services necessary to the operation of said public school' district. 1 3. That the-provisions of Chapter 705, Laws of 19654 are herewith incorporated into this agreement by reference as though fully set forth •herein. . • 4. That the services to be furnished by the City departments shall include tht, following: T. CIVIL, SERVICE BUREAU The Civil Service Bureau of the City of Saint Paul shall continue to provide services to said public school district as it has in the past, pursuant to the provisions of Chapter 7 of the Charter of the City of Saint Paul and pursuant to the provisions l of the Civil Service Rules, being Ordinance No. 3250, as amended, of the City of Saint Paul, such services to include, but not necessarily be limited to the recruiting of personnel, the admin- istration of examinations, the certification of applicants, the classifying of positions, the grading of classes of positions, .'the certification of payroll..:, including teachers' payrolls, and e3tablishment of class specifications. The School Board agrees to abide by and to be bound by the provisions of Chapter 7 of the Charter of the City of Saint V aul and the provisions of the Civil Service Mules are they ,tpr,.ly to the Civil Service employees: The cost to the school disLricL for the furnishing of said services, 2 during 1966 shall be computed by comparing the percentage-of Board of Education Civil Service employees to the total number of Civil Service employees of the City. For 1966, this percentage is herewith fixed at twenty -three percent (23'/) and, in addition thereto# ,a charge of Two Thousand Eight Hundred.Nineteen and no /100 Dollars ($2,819.00) for certification,bf teachers' payrolls, making a total cost to be paid by the school district to the City for this service of y! $35,234.00 The Board of Education herewith concurs in and subscribes i to those benefits heretofore enacted by the City of Saint Paul on behalf of its employees, specifically those pertaining to severance pay as embodied in Ordinance No. 11490, approved June 12, 1959, as amended; health.and'welfare insurance benefits; retirement programs$ ands further, agrees to abide by and be.bound by the action of the Council of the City of Saint Paul pursuant to the provisions of Ordinance No. 6446, adopted January•230 1925, as amended, from time to time, as it relates to Civil Service employees, including those Of the Board of Education. II. PURCHASING DEPARTMENT The Purchasing Department for the City of Saint Paul shall act as Purchasing Agent for IndepTndcrit School District No. 625 and perform the necessary and usual duties incidental to proper purchas; ing as provided by law. The cost to said School District for services tp be rendered by the Purchasing Agent shall be computed by applying a formula using a weighted unit value to the total number of purchase orders an4 bide, both formal and informal,. processed by the 3 I r- Purchasing Agent during the calendar year on behalf of the School District. The School District shall pay to the City the actual costs incurred by the Purchasing Department as measured using the aforementioned formula. The estimated coat,. using the .aforemen -, tioned formula, for the year 1966 is: $48,000.00 • ITT. CITY COMPTROLLER The office of the City Comptroller shall continue to- furnish service to 'Said public school district, including but not necessarily limited to the handling of Appropriations, Bonds and Interests, General Administration and Clerical, Payroll Audit, Vendor Disbursing Audit, Receipts,. and shall continue to advise the Board of said School District in regard to bond matters. The pro rata cost to said School District during 1966 for this aforementioned service shall be: $31,520.00 IV. CITY CLERK ' d The office of the City Clerk of the City of Saint Paul shall continue to furnish services to said public school district in the matter of registration of voters and the handling of all elections pursuant'to law on behalf of said public school district. The pro rata cost to be paid by said public school district for the services to be furnished during 1966 shall be based upon thirteen percent (13/) of the total expenses incurred for elections and registration of voters. V. j� PARKS AND RECREATION Due to the existence of a prior policy agreement between r the Department of Parks and Recreation and Public Buildings and said public school district, which provides generally for a sharing of facilities for the mutual benefit of the parties, it appears desirable to continue this relationship. It is herewith agreed that the Department of Parks and Recreation and Public Buildings shall pay to the School District the custodial costs involved for its use of facilities operated by the School District. It is the intent of the parties that the prior policies regarding this matter be herewith affirmed= provided, however, that the Board reserves the power to amend or modify by letter agreement between the Board and the Department any prior policy provision. The services to be performed :hall include the disbursement and mailing of vouchers, the handling of receipts, general administra- tion, and bank account reconciliation. JOINT COURT HOUSE AND CITY HALL COMMITTEE The School District shall enter into a lease with the Joint Court House and City Hall Committee providing for the rental of space within the Court House and City Hall of the City of Saint Paul, said lease to contain the terms and conditions relating to the use of portions of the premises by the School District, and to fix the rental costs for the use of said premises. VIII. CORPORATION COUNSEL The office of the Corporation Counsel shall continue to act as attorney for the Board of Independent School District No. 625, including attendance at meetings of the Board, prosecuting and defending all actions on behalf of the Board, rendering of legal opinions to the Board, representing the Board in all pro- ceedings, including the Industrial Commission and other administra- tive tribunals= provided, however, that upon certification by the Corporation Counsel that a conflict of interest exists due to representation of City interests, the Board may employ other counsel pursuant to the provisions of Chapter 705 of Laws of Minnesota for 1965. Any investigative expenses shall be adjusted at the end of the calendar year between the Board and the office of the Corporation Counsel. The pro rata cost to be paid by the School District for the above services in 1966-shall be: $15,000.00 5. In consideration for the furnishing of the afore- 11 mentioned services, the School District shall pay to the City of T Saint Paul, in equal installments, on June 15, 1966, and on or before December 15, 1966, the total amount due for City services in the amount of $203,712.33 The above stated amount to be paid for City services includes those rental charges as provided for-in a lease executed between the public school district and the Joint Court House and City Hall Commission as hereinbefore provided in Paragraph VII. Payments shall be made on these respective dates pursuant to this contract and upon Registered Bills being sent to said School District from the office of the City Comptroller. Payments shall be made to the City of Saint Paul. 6. Nothing herein contained shall be construed as a limitation upon either party to renegotiate the terms or provisions hereof or in any way to bind either party subsequent to 1966. IN WITNESS WHEREOF, the appropriate officers of the City of Saint Paul and the appropriate officers of Independent School 1: District No. 6250 pursuant to authorization by resolution of each governing body, herewith execute this agreement this day- of December,1965.
