2 WHEREAS, a request has been received from Burnet Tit1e for the release of easement rig�ts for slopes,
3 cuts and fills, originally taken by Council File No. 29926, approved June 22, 1909 (also as set forth in Book
a T of Plans, page 2�t, Ramsey County Records) affecting the property located at 373 Victoria Street South,
5 Saint Paul, described as Lot 1, 2, and 3, Block 3, Slaton's Linwood Park Addition; and
7 WHEREAS, the Department of Public Works has determined that said easement rights affecting 373
8 Victoria Street South are no longer needed by the City of Saint Paul; now, therefore be it
io RESOLVED, that based upon a Certificate of Intended Non-Use filed voluntarily by the Department of
11 Public Works for release of said easement rights, the Council of the City of Saint Paul, on behalf of the City
iz for itself and said department, does hereby waive and release the above-described easement rights affecring
13 373 Victoria Street South; and, be it further

15 RESOLVED, that upon passage of this resolution, the proper City officials are hereby authorized and
t6 directed to record a copy of this resolution in the office of the Ramsey County Recorder; and that the City
1� Cierk shall maintain on file a copy of the Certificate of Intended Non-Use referenced in this resolution.

The owner of this property wishes to sell it, but the buyer will not close unless the easements aze released. The Depaztment of Public
Works has reviewed the easements, which were taken in 1909 for gsading, fills, cuts and slopes. These easements ara no longer
needed, as documented in the attached Certificate of Intended Non-Use
