WHEREAS, Comptroller's ContPact L- 6170 -26, ,Ashbach Construction
Company, for the Grading and Paving of SHEPARD ROAD from West
Seventh Street Boulevard to Davern Avenue and MISSISSIPPI RIVER
BOULEVARD from West Seventh Street Boulevard to the east -line of
Section 21, has been completed, and
WHEREAS, said Contractor requests that a portion of the 15% re-
tained under the contract from estimates for work done, be paid
to them in advance of the final settlement of the contract, and
WHEREAS, The Commissioner and Chief Engineer of the Department of
Public Works approve payment at this tim9 of $ 25,198.60 of the
50,397.20 retained, therefore, be it
RESOLVED, that the proper city officers be and they are hereby
authorized and directed to pay an estimate in the amount of
r $ 25,198.60 from the percentage retained of 50,397.20 to said

contractor, and be it
/1 f- FURTHER RE SOLVED, that the action of this* C ounci 1 shall have no
force or effect unless the sureties on the bond furnished by
said contractor applicable to this project, consent thereto
and file such consent in writing with the City Comptroller.
