RESOLVED� upon the pertinent appeal of James R. Troje�
. under the Zoning Code� for a waiver of lot size for a single-
family dwelling in "A" Residence District� for property on the
northwest corner of Annapolis Street and Livingston .Avenue,
more particularly described as Lots 5 and 6, Block 3� St.
Pierre and Lawtonts Addition to St Paul, that the general
provisions of said 'Zoning Code� as they apply to area require-
ments for single-family dwellings in "A" Residence District,
are hereby determined �to the extent necessary therefor and the
applieant be and hereby is permitted to construct a private
single-family dwellin�g on the west 56 1/2 feet of Lots 5 and 6,
Block 3� St. Pierre and Lawtonts Addition to St Paul; subject to
the condition that said applicant-permittee� and his successors
and assigns� shall make due compliance with all applicable
provisions of municipal ordinances, State statutes and rules
and regulations of public authorities having cognizance.

This is in the matter of the appeal of James R�. Troje requesting
authorization to r�divide two platted. lots now developed in part
with a single-family house, for the purpose of constructing a
second residence thereon. The subject property=is located at the
northwest corner of Annapolis Street and Livingston Avenue and is
described as Lots 5 •and 6, 'Block 3; St.Pierre & Law.ton'_s �Addition.
The property is zoned "A" residence. _ � ` " -

The Board of Zoning at its June 4th meeting reconsidered this
matter as requested by the City Council. ,, The Planning�Board staff
reported that the �roposed redivision would create a lot of 3,783
square feet which is approximately 24.3qo below the minimum Iot area
requirement of 5,000 square feet. There is •no way: of reducing
this deficiency because the rear yard requirements o� the Building
Code must be applied. - �
After considerable deliberation by the Board., it was pointed out
that had the two subject lots remained vacant, ea�ch lot could be
. developed as.platted with a single;�family residence. It was the •
Board of Zoning's conclusion that the request was reasonable, and, -
therefore, it is recommended that the appeal to permit a single-
family residence to be constructed on the westerly portion of
�
Lots 5 and 6, Block 3, St.Pierre & Lawton's Addition be .granted. •

St.Pierre & Lawton's Addition. . - -

The Board of Zoning considered this matter at its regular meeting on
April 1, 1965. The Planning Board staff:reported that the subject pro-
pArty consists of. two 39 foot wide platted lots fronting on Livingston
Street and having a total area of 8,814 square feet. The requested re-
division would be ��or the purpose of constructing a residence on the west •
74 feet of said lots which would have sufficient lot frontage and area.
The proposed division would place the existing residence one foot below �
the minimum 1ot width requirement of 40 feet, and approxim�ely 1,642 square
feet short of the minimum lot �area requirement of 5,000 square feet. � It
was the Board's finding that the requested relaxation was too substantial .
and therefore would not be reasonable or in keeping with the purpose and
' intent of the minimum lot area requirements. The Board also concluded that
. the denial of this request would not cause hardship ,on the applicant as he
- may continue to enjoy the present single-family use of the land. �
In consideration of these findings, the Board of Zoning recommends that
the appeal to permit a redivision of Lots 5 and 6 so as to permit a second
residence to be constructed thereon be denied.

Many years ago this home was built on two lots. Whea�
we purchased this property we figure� tfiat some day � when we
could afford it� we would build a ne�H�ethe west side of the
old home . We thought this was,possible because there are two
lots here and the existing ol'der home where we live is locatedi
orn the egtreme elsd of d;he �ast end, thus leavirng tFiis large
open area to the West. The area on which we would like to build
is of no value to us presently and,we are ira great r�eed of
a larger home a.rsd do not wish to leave this axea.
