An ordinance amending the Zoning Code�
Chapters 60 to 6�+, inclusive, of the Saint
Paul Legislative Code� pertaining to Use
Districts� Height Districts and Rezoning of

� as amended. This is an emergency ordinance �
; rendered necessary for the preservation of th e

' TH� COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Zoning Code� Chapters 60 to' 64,
. inclusive, of the Saint Pau1 Legislative Code, pertaining to Use
� Districts, Height Districts, and Rezoning of certain properties
in the City of Saint Paul� as amended, be and the same is hereby
furth'er a.mended so as to rezone the following described property
on the terms and conditions expressed herein from "B" Residence
District to Commercial District, to-wit:

, "All of Lots 13� 14, 15, 16, and the west 1/2 of Lot-
17, Block 13, Terry� s Addition to the City of Saint
' Paul� County of Ramsey and State of Minnesota;'"
situate on properties located at the northeast corner of Bush
Avenue and Cypress Street in the City of Saint Paul.

� Section 2. The property deseribed above is subject
to the following express eonditions:

That� subject to any� further reclassification af� the .
hereinabove described real estate by virtue of proceedings therefor
hereinafter instituted, conducted and completed according to the
applicable provisions of said Zoning Code� effective as of the date
of said petition for reclassification and the applicable provisions
of the statutes of the State of Minnesota� hereby, the employment
of said real estate henceforth is restricted and limited to the
following specified uses� to-wit: ��
I Commercial District for the installation and operation
of an employee' s parking facility by petitioner� subject
� to all applicable statutes � ordinances� rules and regu- �
f lations prescribed and promulgated by governmental
` agencies--having cognizance. -
. 2. That the owner of said real estate, within the period
of sixty (60) days next succeeding the publica�ion of this ordina.nce�
shall file with the City Clerk� in two (2) fully executed counter-
parts� said owner' s written acceptance of this ordinance, incorporating,
among othe� things, said owner' s grant unto said City of Saint .
Paul of a negative easeme�t affecting said real estate, for the
imposition., maintenance and enforcement of the aforesaid restric-
� tions and limitations upon the employment and use of the property

shall incorporate a certified copy of this ordinance, and .
immediately upon the aforesaid filing of the same the City Clerk
shall cause one of such counterparts thereof to be filed of
record in the office of the Register of Deeds in and for Ramsey

The .sub�ect property is presently developed with three (3) residence
structures and accessory buildings. It is proposed to remove these

lot. The half block�, within which the subject property lies� is classi-
, fied "B" rResidence and_ the predominarit adjoining and immediate surrounding
uses are single-family residences. -

� there is ;a definite need for additional off-street parking because of
continued industrial growth in the area north of East Seventli Street. -
It was tlie Board's finding that t15is property could be developed and
used for �parking purposes in a manner which would not be detrimental to
the residence uses in the area. �
Based on �the above findings,�=the Board of Zoning recommends that the .
above-described property be reclassified from "B" Residence District
