and for Ramsey County� Minnesota; that the provisions of said .
Zoning Code, in respect to density an.d land area requirements�
hereby are determined and varied� in their app lication to said
real estate� as and to the extent necessary to accommodate a
28-unit apartment building, and that a permit may be granted
unto said appellant� and his successors and assigns, in respect
of said real estate� for the erection of said 28-unit apartment
development ontthe above described premises; and
R�SOLVED FURTHER� That said Arthur S. Jurgenson be
and hereby is permitted to install and operate a 35-car off-
street parking facility accessory to said proposed 28-unit

This is in reply to the referral of Arthur S. .Jurgenson's 1) appeal to
_ relax the density standards to pe'rmit a 28 unit`apartment building on
a lot of znsufficient area, and 2) application for a 35 car off-street
parking, lot accessory thereto on property located on the south side of
Front Street between Dale;a and St .Albans Streets. The subject property
is desc�r3bed as Lots 4 thru 9 inclusive, Block l, Butterfie'ld Syndicate �
Add��2 and is zoned commercial. �

� The Board of Zoning considered this matter at its regular meeting on
� April 15, 1965. The staff reported that the subject property has an
area of; 29,240 square feet and that the required area for a 28 .unit�
_ �
building is 29,400 square feet which results in a shortage in area of
" 160 square feet. The staff reported further that the parking lot plan
met a11,of the required standards for this type of facility and had been
reviewed�and appro�ed by the Traffic Engineer. It was the finding of
� the Board that the shortage of 160 square feet was minimal and would not
have a detrimental effect on the neighborhood. It was also felt that a
residential use on the property would be preferable to a commercial use
for which the site qualifies. ,

In consideration of these factors, the Board of Zoning recommends the
granting of the appeal and application for a permit as above outlined
for the above described property in accordance with final plans dated
received May 18, 1965. �
